It might work, short term-ish, but eventually there are going to be issues to resolve:
- 2 non-resident brothers retain an interest in the property, the value of which would have to be declared in the event of divorce, death, or a need to claim means-tested benefits or support with care
- The rent income would be subject to tax
- CGT would be payable by each of the non-resident brothers on the eventual sale
- Is the resident brother going to be able to maintain and insure the property? What if he doesn't do this to the satisfaction of the non-resident brothers? What if there are major improvements or repairs needed, and the resident brother either can't afford or chooses not to deal with them?
- Either of the non-resident brothers might decide to move in. One of them already wishes to do so, in the future if not immediately. They have that right.
