PCM Question

Options
Hi

Recently we had to drop our daughter of for her first year at Uni and was directed to park opposite the entrance to unload in a street with several businesses (car wash, clothes shop etc) and when we asked about any parking restrictions were told "it should be fine" by the uni team. We could not see a machine or any notices about not parking and as there were several business there parked up.

I have received the following today in the post and was wondering if I should pay or should go to the appeal part of their website and enter the blue text from the newbie advice "I dispute your 'parking charge', as the keeper of the vehicle etc etc"

Any help obviously well received - Thanks in advance

Complain to the Uni Facilities Team.

Nobody EVER pays PCM here! Eek no.

Read the fourth then second post of the NEWBIES thread (in that order) for what will happen next year. Unless you act quickly for the Uni to step in and cancel this aggressive charge from an ex-clamper who were outed on Watchdog.

You don't pay money to such scum.

    That PCN states...
The terms and conditions for use of the land at Robert Dashwood Way - SE17 are clearly stipulated by signage posted throughout the area.

Show me any sign clearly stipulating anything about parking in this Google Street View image...

That GSV image was captured in July 2024 so it's highly unlikely that any signs have appeared at the southern end of Robert Dashwood Way in the short time since then.

Thanks for taking the time to respond and I will read the sections you have indicated.

Just to point out that the Uni has no control or influence here, it just happens to be a side street that is opposite them,

It is the other end of the street and I have just noticed (from Google Street view) there is a notice

    Sorry, I don't understand.
What's 'the other end of the street'?

Surely you want to use the best evidence to support your case.
The parking company have no idea which end of the street you entered by, do they?

And the sign isn't prominent. No contract.

Please take the advice already provided, as we know exactly what we're doing.  You do NOT pay this fake 'PCN'.

NEVER park where there's a scammer sign. It is never safe. You will never be able to use that road to park at ends of terms, etc., while your daughter is at Uni. Find a proper (public highway) road round the corner (NOT a privately run car park, obviously!).

It is clearly a scam site and you should tell the Uni Facilities Team what happened and complain. They need to stop telling parents that "it'll be OK".

OK - I have read post 4 - "IGNORE THE DEBT COLLECTORS' STAGE"
I have read post 2 - "Pre Action Stage"

(just to check that was what you meant)

So these (from my reading) are outlining what to do if PCM have engaged a solicitor and then it has gone to a debt collector.

Based on the fact I only received the "Postal Notification" today AND that this street is nothing to do with the Uni so I cannot complain to them/ask them to interceed do I now go to post 1/point 2 appealing a private PCN? If so as the note is to the registered keeper (my wife) and not the driver (me) and use the "TEMPLATE ''ONE SIZE FITS ALL'' FIRST APPEAL THAT DOESN'T SAY WHO WAS DRIVING:" and either email that or enter the details on their site as part of the appeal?

Sorry if I am being thick/slow but I cannot tell if I do that or just ignore it

Other way round. Debt crawlers first. Ignore them when the case gets to £170 threatograms 'silly stage'.

Why isn't your wife just transferring liability at this stage to you (as per the PCN which explains that option)? Is it a deliberate decision not to do that because your wife wants to keep it in her name because she'd be a more robust person to defend a daft court claim in 2025?

  • Sorry for the delay, I have had a family bereavement to deal with.

Re: Why isn't your wife just transferring liability at this stage to you

I had just received this and had not even considered this, was looking for advice first.

Can I ask in very simple stages what I need to do please as it is not obvious to me from above. Is it:

    1. Transfer liability
    2. U
se the "TEMPLATE ''ONE SIZE FITS ALL'' FIRST APPEAL THAT DOESN'T SAY WHO WAS DRIVING:" and either email that or enter the details on their site as part of the appeal
    3. Ignore letters from "debt crawlers"
    4. Follow
post 2 - "Pre Action Stage"

Yes. Except you missed out 'plan A' as set out in the NEWBIES thread:

Complain to the Uni Facilities Team.

AND you can't transfer liability. Only the keeper can do that.

Or, given the fact that you are in time to appeal, you could appeal admitting to driving which has the same effect.
