pip and entitlement to UC housing element

my daughter receives PIP daily living and has been made redundant she applied for UC but was told it would be zero apart from her jobseekers allowance because her partner earns above the amount needed for her to get housing costs as she pays rent to a  estate agent but turn to us calculator  state that non dependants shouldn't count because she gets daily living part of PIP so who is correct or is non dependant something else in this case or is a partner not classed as non dependant

    fo UC it would be a joint claim with her and her partners income

    (from a google search) A non-dependent for housing costs is someone who lives in your home but is not a partner, child, or someone who is jointly liable for rent or council tax. Non-dependents are typically adults who are expected to contribute to household costs. Examples of non-dependents include: Grown-up children and Elderly relatives.

    So just to be clear here.
    She lives with her partner?

  • her partner is not liable for the rent or council tax as he has only moved in a few months ago is not mentioned on deeds or council tax bills but does contribute 
  • It's still a joint claim as they live together.

    Who told her what her entitlement would be?

    If her partner provides 35+hrs of care they can have the carer element on the claim, and if your daughter is assessed as having LCW or LCWRA they'll have the work allowance* which will increase their UC.
    *An amount of earnings ignored before they start making deductions.

    LCWRA would mean an extra amount of UC payable from the fourth full AP after reporting her health condition.

  • Also, her partner (if living with her) should be on the Council Tax.

    I suspect that the issue here may not be one of entitlement to UC-HE, but that the partners earnings are at a sufficient level where the deductions for earnings would nil any UC payment anyway?
