  • Telephone mediation today! 
  • The lady on the mediation phone call said that the other party identified my templated response seen on the internet, and that they issued the fine within good reason. She also relayed that there was no screen shot of my bank details added into the defence (which I believe wasn't needed at that stage?). They tried to negotiate a reduced fine initially from £282 to £250 to £150, said no to all these offers and now a hearing date will be issued. I believe I have done everything by the steps but she did read out the risks and not going to lie, doubting I’ve done it right.

    Mediators are supposed to try to get both sides to come to an agreement on how much the other party is agreeable to paying NOT act as judge and jury.  No evidence goes with a defence so you are right in that respect.  Just because a defence has "been seen on the internet" means nothing; one judge even commented in a hearing when the solicitor tried that on "So what!".  Report the mediator to CNBC scmreferrals@justice.gov.uk

    You played it perfectly.

    Complain about her to the Mediation Service. They are unfairly scaring Defendants by repeating total rubbish from parking firms.

    Who cares that the defence is a template? So are all their submissions!

    And no evidence goes with a defence.

    Completely irrelevant for her to say that and totally WRONG to tell you that you 'risk higher costs' because you DON'T. The Mediation Service needs to stop telling people that. It is not true in parking cases, where the claim is already inflated by £70 per PCN plus interest which will not be allowed by Judges. Defendants pay LESS THAN THE CLAIM if they attend a hearing & (rarely!) lose.

    There's zero risk with parking cases.

    Please complain.  This needs to be changed.

    Thank you all for help this far. Just an update. I’ve had a notice of Transfer Court proceedings to my local court today. Reading other threads, I understand this is normal. I am hopeful Bay Sentry will cease to continue soon! What does the abbreviation mean for “WC stage”

    Probably meant WS stage = Witness Statement stage

    They will discontinue soon

    Ignore them and wait for the N279 NoD document to arrive in due course,  always checking your spam folder as well as your inbox

    Update: I have had an n157 in the post today. Fingers crossed for N279 NoD soon. Had numerous called from DCB legal trying to negotiate (ignored).
