  • Nice defence.  That is a strong case that a Judge will like.  Very reasonable from you and the Claimant clearly is trying it on and has no cause of action.

    Be firm at Mediation stage. No offer: end the call "good day". Phone down!

    Let's see the Claim Form when you can, as we need to know if this was filed by Elms Legal or by DCB Legal(?) and we will need to help you at Witness Statement stage before the 2025 hearing.

  • Oh good!  DCB Legal.  They always discontinue before hearings, so no concerns with this.
    So would this mean that they just wouldn't proceed to court? Or would they find another company to take me to court on their behalf. Sorry for all the questions, completely new to this!

    Wow, so it really is just a scheme to scare members of the public in to paying. All whilst taking up time and costs from the defendants and the courts. Thank you for all your help thus far. I'll likely make a post after my Mediation call which I will end swiftly. From then it will be waiting for a court date and then witness statements before they offer to settle then hopefully discontinue?

    It really is. I know when I was making my defense there was an option to countersue, has anyone went down this way with a parking company, could you even countersue under say the equality act if you were disabled etc, or anything else?

    Mediation call was fine. They offered to settle for £180, I told my side of the story and refused their settlement offer. Told the mediator I wouldn't be willing to pay anything so she ended the mediation. I'll expect a court date letter next?
  • Received a letter with a court date of 13th January. I have until 16th December to provide any witness statements. The only person in the car with me was my girlfriend. Shall I just get her to do a witness statement? Thanks
