That was a long read and it was VERY USEFUL to read that Swanley Council can cancel 10 PCNs per month and that they threatened to kick out CE (same company as Care Parking):

I'm assuming the council get a fee instead of a % of the fines?

The following section seems pedantic to me, it misses the point entirely through obfuscation , IMHO

F. Can you please provide a copy of the contract you have with CE.  Sensitive information is not a valid excuse to withhold it and the decision is not CE's, it's yours. I will accept a copy with names, email addresses to be redacted (nothing else).

 

(Answer). As aforementioned the Town Council do not hold the agreement directly with CE. The agreement is with CCP.

The BPA list shows various names under CEL, their answer smacks of the same obfuscation where Excel send out a PCN but the signs say VCS, or Minster Baywatch but the signs say Bransby Wilson 

Creative Car Parks is a trading name, but Civil Enforcement issued the PCN and Civil Enforcement have cancelled it due to the fuss, not out of goodwill or any altruistic motive. !

It seems to me that they used obfuscation in order to not disclose the contract 

Care Parking is under Anchor and trades as Ocean, so unless there has been a buy out or merger, I don't see any connection there

There are definitely no "fines" involved here, magistrates issue fines and this case hasn't involved any magistrates

No, the landowner gets all or most of the parking fees. That's how these scams work.

The scammer gets the 'fines' (they're not fines...) and thus the scammer is incentivised both to issue as many as possible, make the terms non-prominent and then not to cancel any on 'appeal' (there's no appeal)..

It might look like a comprehensive reply but they deliberately didn't really answer some questions and padded it out with stuff like that, which you never asked. You didn't ask them if they get a % of anything. I deliberately didn't write that in the questions because I know they don't.

Creative Car Parks doesn't exist but Creative Car Park Ltd does BUT it's not a BPA AOS member.

Swanley Town Council are subject to the F.O.I act. so the contract can be requested under that act.

Nice of the council to confirm that their contract is with CCP and not Civil Enforcement Limited.  Always useful at the court stage and one of the reasons CEL claims don't go all the way to a hearing.
