Speeding Fine NIP

Options
Hi Everyone,

I got caught speeding when I went into an average speed camera zone on the M1 missing the first marker, but I got flashed so they must have had a fixed camera on this bridge I was passing as well!

I had taken my foot off the accelerator to drop my speed before I hit the first average speed camera (Waze satnav tells you where they are)

So the NIP arrived within 5 days and I admitted the offence and returned it which was @1.30am on the 06/03/24 and heard nothing back from them until a week or so ago a 'single justice procedure notice' arrives dated 04/09/24 which is exactly 6 months after the speeding offence!

And say it took 2 days without delays by RM to deliver it, would this make it statute barred?  Or would they go off the NIP letter I sent back to them?

As we major on private parking tickets here, Free Traffic Legal Advice forum will be your best bet for police tickets. If you do receive a ticket, register there but please note that a hotmail address may not work - try using a throwaway Gmail account instead if you do have trouble registering and post a new thread; here's your link:
Have a read through some of the other threads, including 'Read this first before posting your case' (and use the NiP Wizard) there before you post your own to get the hang of what information they need from you in your opening post - but as a minimum you will need to post redacted photos/scans of all correspondence you've received from the police (both sides, if appropriate) as they need to see all the small print.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • The Police have 6 months from the date of the offence to commence proceedings. This means that they have to file their papers within that period. There is no obligation for you to receive Court papers within 6 months and indeed, the Court will issue papers outside of that deadline if the file has been received in time. The Court will always confirm the date papers were received from the Police, i.e. Date Information Laid, so if you are in any doubt about the validity of the papers, check this date.
