No contract & pay issues

New employer refuses to give me a contract stating conditions and pay.

After several months, and taking a weeks  leave , I didn't get any pay  for this, and when I asked why , the reply was holiday pay is included in my wages every month.

I definitely need some advice here , before I start rocking the boat .

So.

No contract. No pay slips, no holiday pay

    On the payslips you've had so far, was this holiday pay shown separately?

    A year of.employment

    By law (Employment Rights Act 1996), employers must give all their employees and workers payslips from their first payday. Workers can include people on zero-hours contracts and agency workers. Agency workers get their payslips from their agency. People who are self-employed do not get payslips
    So your employer is breaking the law

    Were your wages for the month when you took a week off the same as a month where you havent taken any leave ?

    Do you work fixed days and hours ?

    I think that's very unlikely. It would mean that if you get extra pay every week you work and none when you are on holiday, then if you didn't take all the holiday you are entitled to then at the end of the year you would have been overpaid because you didn't take the 'unpaid' days

    That's going to be a bit difficult if the employer isn't co-operative and won't give any sort of payslip or invoice
  • They could be breaking minimum wage laws if you are on minimum wage so you could report them for that.

    Then your employer is breaking the law. You are entitled by law to a payslip that shows all payments and deductions
    What is your hourly rate?
