County Court Claim by DCB Legal

Hi,
I have looked through the board and continue to do so, but wanted to see if I could get some direct advise or pointers.
Received a County Court Claim form Issue Date 2 Sept 2024, DCB Legal for Parkhaven Limited
POC details 'No Valid Parking Session.

I have gone through MOL and made an Acknowledgment of Service on the 10th Sept 2024

Facts:
Had the letters from dcbl and then more recently dcb legal as registered keeper. Called them a few times told them it was paid, I am the registered keeper, refused the liability for the PCN. Told them there had been a mistake and to investigate this, just met the usual response, I will record your refusal to pay.

I am the Registered Keeper of the Car, it was used on said date in the Car Park,
I was not the driver, I have official documentation to prove I was not in the UK at the time and could not possibly have been the driver as claimed.
I have bank records showing the payment was made by one of the occupants of the vehicle.
I have recently contacted the payment company, they have claimed they cannot find a record with the details I gave, I have given them (some of) the card details which was used to pay (again not mine) so that they can locate the transaction, this is dragging on now. I have followed this up and received a delayed response (today) saying it was taking longer than usual and not to contact them again as it may affect my place in the queue.

    His will be the same as all other DCB Legal single PCN claims: they'll discontinue in 2025.

    I have gone through MOL and made an Acknowledgment of Service on the 10th Sept 2024.

    With a Claim Issue Date of 2nd September, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 7th October 2024 to file a Defence.

    That's over three weeks away. Plenty of time to produce a Defence but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
    Don't miss the deadline for filing a Defence.

    Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.
  • Yes, sorry Parkmaven, I must of been thinking of a Holiday Park!!

    I have received a further email from the company which takes payment and they claim to not be able to find any payment, money was clearly taken from the account of the person who payed the parking and they have lost it, and this will be the reason for the PCN, I have requested that they escalated the matter and inform their business partners to discontinue any action.
    It is such a bent and corrupt industry parking.
