With a Claim Issue Date of 3rd September, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 7th October 2024 to file a Defence.
That's nearly four weeks away. Plenty of time to produce a Defence but please don't leave it to the last minute.To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.Don't miss the deadline for filing a Defence.
Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.3 -
The PoC state, Walsall Waterfront. The photo of the sign states, Walsall Waterfront Leisure Car Park. The GSV image from 2020 shows the sign for that car park is facing 180 degrees to the direction a motorist would have to travel when entering this car park, which is adjacent to a Premier Inn hotel and car park.
There are no signs in the one car park in that GSV image, and only one at the pedestrian exit of the hotel car park. You should get photos of the site and signage to see what it looks like now.
The Waterfront area is divided by the Walsall Canal, and the old tow-path is identified on maps as Waterfront S, presumably meaning South. There are private properties to the south but still within the waterfront area.
To my mind, the PoC does not define the relevant land where the alleged event occurred. It is not specific enough to determine where the alleged event occurred. There are other car parks in the (Walsall Waterfront) area belonging to other private businesses that are infested by other PPCs, and some areas that are council controlled.

I didn't realise I was - This is why I'm here. I'm trying to sort this in-between my work day job and all the text becomes a bit of a blur and I loose some of the context. No problem - it is just that you will be signing the Defence and WS under a statement of Truth. Therefore any c & p statements must be relevant to your case.4
