Music Magpie:, anyone else going or been through small claims process with these guys

Appalling Customer service and total lack of interest when issues arrive?
I am sure if everything goes to plan then the company is as good as any other. Unfortunately, when it doesn;t the customer service mentality appears to be "we are right, you are wrong so go away" Despite losing track of my parcel on a couple of occasions and, according to the tracking system still believing it is in the system. Music Magpie are blaming me for damage to a phone that was damaged after they had left my possession. The downgrade was from £80 to £7.50. I have exhausted internal complaints processes and issued a notice of intention to go to small claims, still awaiting a response (it's not the money it's the principle). From my experience they are a total waste of space and In future I would take my goods to the nearest cex, cash converters or whatever rather than trust this lot, Never again and having built a timeline of events I'm confident I will get my money eventually. It really shouldn't be this difficult. Has anybody else been down this line with them please, experience to date is that they just ignore all communications. Thank you

Presuming you had postal insurance to cover the damage.Failing that, going to court will be a case of you saying you sent it in good condition and MM receiving it damaged.0 -

Typically, Music Magpie arrange the postage / courier - so it would be for them to arrange insurance.
In fact, a quick look at their t&cs suggests that they insure items up to £150 while in the postal system. But there are caveats about items being correctly packed etc. But @Galey2000 needs to check the specific t&cs they agreed to.
@Galey2000 - have you asked them to make an insurance claim?
Obviously, if you go to court, you'll need a legal basis for bringing a claim against them. If it's for breach of contract, you need to explain the terms of the contract (including applied terms) that they have breached.
Alternatively, you could make a claim for negligence, if you think it was them who broke your phone.

@Galey2000
Hi, sorry to read what happened to you but after some many searches it seems to be a lot of similar stories. I hope you got the above resolved. I am having issues with them too and out of curiosity did you go to small claims and if so what was the outcome.
Many thanks0
