Morrisons/Euro Car Parks Final Notification Letter

I have been issued with a final notification letter from Euro Car Parks for parking in a Morrisons car park whilst on holiday with my family.  The outstanding balance is £100.  Firstly, as this is the final notice, the first PCN did not even arrive through our letterbox, so goodness only knows where that got delivered to, or if ECP even sent it out to start with, and, of course, I do not know what the original charge would even have been.  So I was a little surprised by this to say the least!  

Anyway, the breach was that the vehicle overstayed the maximum time allowed (the car was parked for around 2 hours and 30 minutes).  We are not local to the Morrisons we visited (we live about 200 miles away) so I can't say that I remember seeing any signs to say how long parking was acceptable for.  However, on that particular day in question, myself, my husband and my two young children only used the facilities within that store; we ate in the cafe, that I remember took ages for the food to arrive, we went shopping and we used their toilets because my 4 year old wasn't feeling very well.  So I remember it well!  

We have contacted Morrisons head office only to be told that ECP are a separate entity to them and they cannot do much to help.  The only advice we had from them was to talk to someone at the Morrisons store personally to see what they could do - but as they were unable to put us through to anyone in that store over the phone, we are highly unlikely going to do the 400 mile round-trip again to discuss it personally!  So that was that.

I would like to know if anyone here believes it is worth appealing this PCN.  I am absolutely furious that ECP are demanding £100 from us just because the first PCN didn't arrive in the post.  If I appeal on that grounds, of course, there is no way that I can prove to them that this first letter did not arrive.  Secondly, I am cross that we were loyal customers to Morrisons and have been penalised for this, especially when my youngest was not well, so we probably weren't keeping an eye on a specific parking time limit.

    You won't be paying it anyway.

    Nor will you appeal on that basis.  No point appealing.

  • Thank you so much for this information.  Luckily we still have the store receipts!  I have submitted this issue directly to Morrisons via Keith's link - thank you.  ECP have given us until 27th September to either pay the fine (which we obviously do not intend to do) or appeal, then ECP will escalate this.  I just hope that Morrisons will reply quicker than that date!  Does anyone have any experience on this?

    Its not a fine, its an Invoice for the alleged breach of the parking contract on that private property 

    The only way you would have to pay ECP is if ECP issued a Court claim and a judge decided that you were liable 

    Yes they do have form for issuing court claims, roboclaims, but also have form for chickening out, dozens of examples of discontinuations on here , so any examples, YES, the forum is littered with ECP examples on every page and there are over 400 discontinued cases in the following link. ( Not all are ECP. )

    Having original receipts as evidence for any court claim is gold dust, despite the overstay 

    ECP will cancel if Morrisons tell them to 

    You keep on complaining to the business until its been cancelled in the meantime, because plan A is Always the best solution, a cancellation by the dog imposed upon the tail

    But it's not a fine and the timeline doesn't matter. Ignore that date entirely.  Forget it.

    Stop concerning yourself with artificial deadlines set by a member of a known rogue industry.

    If Morrisons won't cancel it you'll be ignoring it anyway (contacting ECP's daft debt collector letter-sending agents only if you move house or if you get to the LBC stage covered in the NEWBIES thread second post).
