Surely the fact that hidden and unfair terms are unenforceable would help the OP when taking this up with his credit card provider, who is (i) liable for the money taken when the service was not provided; and (ii) bound by English or Scottish law. The fact that Booking.com have made a partial refund does suggest that they are, legally, the party who accepted payment but failed to provide the contracted service, in which case there is a direct link and so the credit card provider would also be in the frame.

They have presumably just waived their commission from the sale0
