Rules on moving in with a partner who is on UC

My partner is on UC (LCWRA and Child Element) with a 3 year old child, she isn't too sure if all elements will be lost if they move in with me and the information online seems to be very conflicting. I'm self employed and earning more than the monthly threshold set by UC but would my partner lose all elements of her UC including the disability part? My partner is on PIP but we aren't married and seems unfair for her to lose all of her UC by moving house.

Any insight or information on this would be great!

Thanks

You and your partner would become joint claimant's and any UC would be calculated according to the rules based upon your joint circumstances.
If your earnings are high enough it is possible for the calculation of entitlement to be zero.

    PIP would be unaffected.

Quickest way to get accurate answers is to probably use a benefit calculator provided you are both not subject to immigration control (where means tested and disability benefit entitlement is usually precluded)... try Entitled To and put in accurate details as if you were now living together.

In terms of the benefits system.. for means tested benefits like UC obviously the expectation is that couples that live together share their lives, income and costs.... so joint income and savings become relevant while the marital status itself isn't. You would be joint claimants on a Universal Credit claim if applicable... you would apply and be linked to her claim. Her PIP would be unaffected.

  • Yes, you can lose a lot of money if a person on UC moves in with someone who is earning.

The purpose of UC is to ensure household income reaches a certain threshold.  'Household' being the important term.  If, as in this instance, a working partner moves in then their income is taken into account
  • It really depends how much you are earning.

seems unfair for her to lose all of her UC by moving house.

How is it unfair? Your earnings should rightly go towards supporting her and her child. You'd be a household on a joint claim.
