  • The rules regarding the application of the minimum income floor for self employed people transitioning to universal credit from another benefit are the same as those for self employed people that were not previously claiming another benefit. This means that the minimum income floor can potentially be applied straight away if we deem that applicable.
As far as your fit note is concerned, universal credit regulations state that short periods of sickness for someone who is self employed are regarded as part of the normal pattern of self-employment and you should plan for these periods. There is no change to a your expected hours or the minimum income floor. Long-term health conditions are considered as being outside the normal business cycle. This could still be temporary with the prospect of a full recovery, or permanent - affecting your ability to work for the foreseeable future.
  • Started claim 18th April
    Fractured wrist 16th May
Fit note valid until 30th July

I don't know what to say to that, but for easier reading for everyone else.
  • Sorry for the confusion

This is what they wrote to me when I queried no payment .

'The rules regarding the application of the minimum income floor for self employed people transitioning to universal credit from another benefit are the same as those for self employed people that were not previously claiming another benefit.  This means that the minimum income floor can potentially be applied straight away if we deem that applicable.

So does this  mean that they at anytime they can insist on the minimum income floor even though they can see that I am off sick ?

I dont think 10 weeks is a a short period of sickness and not something I could have planned for.

  • Universal Credit have just confirmed that I was seen as gainfully self employed
  • @NedS I've seen you were in the thread previously but since it's dropped off the front page you may not have seen the recent posts.  Are you able to shed any light on what could be going on here, particularly apparently deciding to apply the MIF from the start?

Yes, I read the response - harsh in my view but the Work Coach is entitled to make such a decision.

If they do not agree with the decision, they should request a Mandatory Reconsideration.

Think we have not had full story.

Did the Work Coach say that you would not have 12 month start up period and the MIF would be applied earlier than 12 months ?

I would suggest contacting Job Centre manager using UC helpline 0800 328 5644 or going into Job Centre asking for a different self employed Work Coach to review, before you submit a Mandatory Reconsideration appeal.
The comments I post are personal opinion. Always refer to official information sources before relying on internet forums. If you have a problem with any organisation, enter into their official complaints process at the earliest opportunity, as sometimes complaints have to be started within a certain time frame.
  • All sorted I am back on the 12 month start up

That was the whole story and with a happy ending !
  • Hooray!  Was that sorted by following the advice from huckster (just for future readers of the thread who might be in a similar position)?
