    You shouldn't need to incur solicitors costs.

    If you feel that you need to engage, just tell them again that you accept no liability for any such debt. They will have to take a decision on how confident they feel about winning a court claim.

    If they send a preaction protocol letter, we can show you how to respond. I've subscribed to this thread

    If they have produced a bill with someone else’s name on, then clearly they are well aware that this is not your debt, aren’t they! 

    The onus here is not on you to prove anything - I certainly would provide them with ANYTHING which gives them any more information about you that they do not already have. In any event, you cannot produce anything proving when “you were liable for the premises” because you never WERE liable! 

    Allowing that your ex flatmate is still a pal, I would not be volunteering anything beyond “I have never been a customer of your client, and have no liability for any debt owing to them. Please stop harassing me”. (Had this been someone you weren’t friends with who still lived in the property ,giving their name could have assisted with it going away. )

  • So this lot have got back quite quickly. They are still demanding that I send proof that we were not resident at the address at the time of the bill they have conjured up. They want copies of tenancies, or council tax bills. 

    Should I provide these? I don’t see why I should be sending documents to a random organisation I’ve never heard of for a debt that’s nothing to do with me. 

    I’ve told them that can search the electoral roll if they want to see who lives/lives on the dates they have provided. 

    Maybe send them another prove it letter? But this time tell them if they persist in harassing me I’ll complain?

    Hi cjawright, can you share any further updates on this? Sadly in the same boat as you are (if not worse). Same premise - bill arriving well after we moved out - except we’re now due at court at some point in the future.
