My mothers husband dies over three years ago. There was no Will so had to go to probate.
My mother paid up front a local company to deal with the estate. He had a surviving daughter who will be entitle to half of the Estate over the £270K.
The 'company' a Cilex registered person then took over 18 months to apply for probate, this was granted about three months after being submitted.
The house was put up for sale and sold in August 2023. The rest of the estate included around £30K in an Isa and a number of shares with different companies. The total value is around £400K.
After a number of complaints my mother received the £270K in January this year. Despite emails and a strongly worded letter she has neither received the balance or any indication when she will receive the rest of the money.
This company has really bad reviews on Google all highlighting the same problems my mother has faced, no response, telephone calls and emails not responded to and important dates missed for filings.
Their own complaints procedure gets no response and in any case it just goes to the individuals partner (not legal partner)
I think the next step would be a letter before action from a solicitor, however what figure do we put onto the letter? Is an estimated amount ok? what should the wording be if we do not know an exact amount?
Whilst we could complain via the Cilex complaints process, however given the number of posts I have seen regarding this company and people looking to take action I am concerned the company could be wound up before Cilex ever look at this. The company was already petitioned last year to be wound up, but managed to dodge that corporate bullet.

Is this company a solicitor or unregulated probate company? If the former there is a proper complaints procedure.

Dispute the lack of a will this could have be handled without appointing this company and the general advice is only appoint professionals if absolutely nessasary.0 -
They have a CPQ qualification and I checked with Cilex that they are registered. Is the money protected at all if the company goes under?0
