Hi all,
We have received a Claim Form from DCB Legal.

Issue date is Aug 2024 and I have filed Acknowledgment of Service 6 days after issue date. I am currently in the process of putting together a defence but not sure as to how to put it all together so need a bit of advice from those that can help.
The keeper of the vehicle is my mum and the PCN was issued on April 2022, the reason was Overstay in a BP petrol station and since it was so long ago we don’t know any details of the Overstay. My mum isn’t the driver of the vehicle because of her health condition so we know that she wasn’t the driver. I am not sure whether we can build a defence around that or not so would appreciate if anyone can offer any advice.

Post the issue date from the top right of the claim form, plus the AOS date, , plus a redacted picture of the POC on the left, hiding the VRM details
Name the parking company who contracted with DCB legal
Not being the driver is a useful point
Study the first few posts in the defence template thread by coupon mad in announcements near the top of the parking forum, use a template to draft HER defence. ( I assume that the defendant is your mum, not you. ? )
Post the first few paragraphs of your draft for checking, do not post the rest of the unchanged template, ONLY your homework needs checking
Everything is done in the defendant's name, you are helping her, but not taking over2 -
Was she likely a passenger? Does she have a Blue Badge?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

She does have a blue badge, the vehicle is from a Motability scheme but, like I mentioned before we are not sure of the particulars of the incident since it was in April 2022.I ignored most of the early letters like it was suggested here but, I did make couple of mistakes along the way like not asking for details of the parking from MET Parking.
I am not sure if we have a case to defend here to be honest because, I don’t know what I could say in defence that would be acceptable as a defence. I would appreciate if someone could suggest some points.

With a Claim Issue Date of 22nd August, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 24th September 2024 to file a Defence.
That's almost four weeks away. Plenty of time to produce a Defence but please don't leave it to the last minute.To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.Don't miss the deadline for filing a Defence.
Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.2 -
There have been no posts on here recommending the ignore route for well over a decade, the advice is to appeal the early letters, not ignore, known as plan B , but after complaining about the PCN to the Landowner first, known as plan A

I have complained to the Landowner but, that didn’t resolve the matter. They told me to make an appeal to POPLA.0 -

I have just received a letter from DCB Legal after I have submitted my defence. Some information about the case is that the defence was submitted like 2 weeks ago. I have mentioned that the defendant is a blue badge holder.Any recommendations as to whether I should give them a call to discuss this matter or not? Has anyone been in a similar situation?0 -
