New sign since PCN

I have revisited the Euro Car Park from where the PCN originated and there now appears to be a new sign. The PCN was issued to me for parking in Winter 2021. Is the elapsed time (over two and a half years) relevant as regards recollection of events/memory - I am well into my 70s. And it being Winter it was very dark - I had taken family and grandkids to Pantomime. I need to get defence in by tomorrow following AOS recently. Many thanks. Any help appreciated.

    Hello and welcome.

What is the Issue Date on your Claim Form?

Can you please show us a picture of the Particulars of Claim - with personal detail hidden of course.

Upon what date did you file an Acknowledgment of Service?
Your MCOL Claim History will have the definitive answer to that.

Where exactly did this parking event take place?
  • Issue date:07/01/2022
    AoS date: 19/08/2024

I am not sure what is Particulars of Claim - nor am I likely to be able to attach photo.
But Reason for Contravention is - The P&D/permit Purchased Did Not Cover The Date And Time Of Parking (Their caps)
  • Parking event took place on 29/12/2024 at Euro Car Park, Wellington St, Stockport
  • Sorry typo on year - 2021

Please try again with those dates.
Are you really saying that the Issue Date on your Claim Form is over two and a half years ago? I think not.
Look for those words Issue Date on your Claim Form - top right.
What is in the box labelled Issue Date

I was asking for the contents of the box labelled Particulars of Claim on your Claim Form, but never mind, you've given enough detail.
  • Apologies KeithP - Issue Date on Claim Form from Northampton Civil Court was 30 July 2024

Issue Date on Claim Form from Northampton Civil Court was 30 July 2024

With a Claim Issue Date of 30th July, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Monday 2nd September 2024 to file a Defence.

That's less than a week away. Plenty of time to produce a Defence but please don't leave it to the last minute.
To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
Don't miss the deadline for filing a Defence.

Do not try and file a Defence via the MoneyClaimOnline website. Once an Acknowledgment of Service has been filed, the MCOL website should be treated as 'read only'.
  • Thanks so much for your help KeithP.
Given the Two and a half year time gap is it of any advantage to state "far too long to accurately remember events"?
I revisited this car park today and it looks very different. All the trees have been pollarded and there are new signs and pay machines. Its been cleaned up!

All of that, and probably more, is useful ammunition against a court claim

The claimant has 6 years to sue you, so not even halfway through that time yet
  • Is the auto reply from CNBC an acceptable acknowledgement of receiving Defence?
They say there will be a response to my enquiry in 10 days.
My deadline for submitting my Defence was 4.00 pm Monday 2nd September. I sent my Defence on Friday 30th August and received an auto reply immediately.
On Monday 2nd September I received an email from CNBC stating my email did not contain a PDF with my Defence within it. I did not discover this reply until late that evening and was at a loss to understand what had gone wrong.
I eventually found that my laptop had not been functioning properly and had not captured the PDF Defence.
I resent my Defence via mobile phone successfully and received an immediate auto reply but on inspecting it the next day I realised it was sent at 01.20 am - ie Tuesday 3rd September. Have I blown it?
