parking payment machine not working, only one in car park

have read newbies thread and also have successfully appealed a previous PCN, for a different matter, 

basically I received a PCN through the post because I failed to buy a ticket, the one and only machine there was 'NOT IN USE' which I got a photo of at the time, there are 2 other methods to pay by RINGGO or paybyphone, tried firstly ringgo and tried to get on website wasn't working, and couldn't get on website, then my phone ran out of power so couldn't ring them

they had my reg on anpr cameras enter and exit car park just below 30 mins in total

in terms of the template I have used it before, just regarding the machine was not in use, do you mention that in the same template at the end and provide the photo of machine not in use message? or just appeal using the template first then provide details of machine not in use at the time further down the line? 

I've tried searching and read quite a few threads but couldn't find anything definitive if the payment machine is faulty

Won't make any difference they will say you should have left if you couldn't pay!

You should have left immediately or not allowed them to capture your VRM on exit, given that you knew their payment methods had failed.

But, to be clear, you are not paying this PCN.  Ignore it. POPLA is pointless for this one.

in hindsight yes i should have, I had an appointment at 12 and was rushing, should I use the template then and appeal it to be awkward or just completely ignore it

Apologies, should I be appealing this PCN with the template no matter what I do going forward, I have to respond by tomorrow (day 28) and I've read the PCN shouldn't be ignored either way

You can do, but ECP will reject it, as would Popla if you subsequently tried it 

The PCN is due to not having a valid permit or paid for ticket, regardless of the faulty machine ( other possibilities may have been available and possibly worked. )

So yes you can appeal, but don't expect any cancellations, other than if plan A worked

Coupon-mad you said don't pay this PCN, ignore it, should I use the template response either way as the keeper, or are you telling me to totally ignore the PCN? 

sorry just wanted to clarify and you seem to have great knowledge on these matters from the amount of posts and stickys by yourself, thank you for the help
