Hello there, 

I'm messaging to get some assistance with this rather new company in the cowboy group. I have followed the newbies advise and send an appeal request as registered keeper to which I got a very swift response with an extensive amount of images. I wanted to get advise on the next steps please. 

The person driving the vehicle was there for about 13.27 minutes. 

The notice to keeper was marked 4 days after the contravention but only arrived 16 days after contravention. From reading the forum that is within the guidelines as it was an ANPR. (Below NTK pages)


The standard template was used to appeal based on the forum's guideline, 21 days after the contravention ( I believe there was no need to wait)

To reiterate this template was used : 

PCN number:
I dispute your 'parking charge', as the keeper of the vehicle. I deny any liability or contractual agreement and I will be making a complaint about your predatory conduct to your client landowner.
There will be no admissions as to who was driving and no assumptions can be drawn. Since your PCN is a vague template, I require an explanation of the allegation and your evidence. You must include a close up actual photograph of the sign you contend was at the location on the material date as well as your images of the vehicle.
If the allegation concerns a PDT machine, the data supplied in response to this appeal must include the record of payments made - showing partial VRNs - and an explanation of the reason for the PCN, because your Notice does not explain it.
If the allegation involves an alleged overstay of minutes, your evidence must include the actual grace period agreed by the landowner.

THE NAME AND POSTAL ADDRESS OF THE KEEPER (OR THE HIRER/LESSEE) GOES HERE, OR IN THE RELEVANT BOX ON THEIR APPEALS PAGE.



The parking firmed responded 6 days after appeal with the below and photos:






from reading up the document I can with 90% certainty say that they are POFA compliant which means that that's out the window. No luck with the land owner either. 

I'm now thinking of recommending to respond 28 days later, requesting updated photos rather than the ones from 25/01/24 as marked on the pictures. In addition, I would add that 13 minutes is not sufficient time to:

1)enter the premises
2) read the conditions thoroughly
3)attempt payment via a specific (Ringo) app
4)download app
5)registration for an account
6)validation of the account
7)purchase attempt
8)due to bad signal/internet decide to depart the premises (MK is notorious for this)
9)return to vehicle
10) drive out of premises

making the PCN unreasonable and unfair.

Any help suggestions, or something that I might have missed would be super beneficial ! Thanks group

    You've left your PoPLA code visible.
    With your heavily masked dates it is not possible to confirm whether the Notice is POFA compliant.

    Thanks KeithP. Totally missed that one and went a little crazy on the information reduction. I've read before that the forum get monitored so I was a little apprehensive about providing dates. 



    Date on sending NTK: 26/07/24 
    Date of incident on first paragraph: 22/07/24 
    letter arrival date in the post: 07/08/24

    date of appeal made by online form: 12/08/24
    date of  response as recorded  on appeal: 13/08/24
    date of actual receipt of appeal by email: 17/08/24
    the date mentioned on response to appeal towards the end of the letter about receipt of NTK: 26/07/24

    NOT THE CLOSE UP OF THE OTHER SIGN.

    Appeal saying that the site is so large and the t&cs so wordy (hundreds of words in tiny print on that t&cs sign!) and the ANPR cameras are positioned waaay back at the entrance, such that a consideration period of 13 minutes is perfectly reasonable for the driver to have reached the spaces round the stadium at the far end, being then faced with reading those ridiculous t&cs (hundreds of words) then returned to the car and left without accepting any parking contract at the stadium.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Thank you ! I imagine the appeal still needs to be made as the keeper still rather than the driver?

    Hi just received simular parking fine from MK1 parking, My daughter aged recently 17 & taking driving lessons, I have purchased a car for her & have noticed on several occasions driving instructor vehicles using the normaly empty parking area adjacent to McDonalds & KFCto take their learners through motoring monuvers, so I decided to take my daughter to the carpark to get her used to driving her vehicle, which is regestered in my name & she is insured to drive as a learner driver. On the day we did not park the vehicle apart from stopping an change seates in order for her to drive the car around the parking area, so there was no actual parking of the vehicle for a length of time, just driving around the carpark for about 15 minutes. Can anyone advice ?
