Consumer rights with third party sellers

Can someone enlighten me with rights and third party sellers. I bought a toaster from The Range via a third party seller. 4 months on its faulty, still under warranty. Contacted the range who contacted seller, was given instructions of what to do for refund, complied and now The Range are stalling and saying awaiting reply from seller again when I’ve complied with their requests for the refund. What are my rights going forwards from here?

I tried to check this out on The Range site. What may be relevant is 3.3.5 in terms and conditions and "sell with us" part of About Us at the bottom of the home page. In my experience, a third party sellers deals with the first year of a manufacturer's warranty but here we are scratching our heads over two retailers. Did you buy it on Ebay or how else did you find the third party seller?

My understanding was that any warranty rights were all with the person who bought the item in the first place, so presumably the person who sold it to you.
So you are reliant on the seller to do their bit because the contract is between them and the range.Any rights you have with them depend on where and how you bought it and whether they are a Private or business seller.All shall be well, and all shall be well, and all manner of things shall be well.

The Range has a market place like Amazon. Wouldn't the OP be claiming from The Range under their consumer rights as it is under 6 months old the retailer would have to prove it wasn't a manufacturing defect.0 -

Depends how the contracts are formed... in most market place setups like Amazon you contract directly with the seller and not with Amazon for an individual purchase. Assuming Range do things similarly they are just a middle man passing messages and not the retailer.400ixl said:
