Hi, there is a very long thread in the Debtfree Wannabee forum started by blueback, called Charging Order? The Myth. It's not for now, you've enough on your plate. But sometime read that and if you need to sell discuss with potential solicitors before you appoint them.

I'm so sorry for your loss.

Was your husband in a union or benevolent fund?

My husband is an engineer and has paid subs into the benevolent fund to the Institute of Civil Engineering for decades and said that should he die and I need money, to contact them.  A long shot....

I wish you the best to get this sorted out.

    Sorry for your loss.

Have you checked to see if your husbands workplace had a "death in service' that might pay out?

A further update it says on the title register: Proprietorship register Class of title: Title absolute then both mine and my husbands name. Then under restrictions it says:

No disposition of the registered estate other than a disposition by the proprietor of any registered charge registered before the entry of this restriction is to be registered without a certificate signed by (then goes on to add both the creditors names)  or their conveyancer that written notice was given to (then both creditors names, being the person with benefit of an interim charging order on the beneficial interest of (my husbands name)  made by the county court

does anyone know what this means? so sorry this is so confusing to me and doesn't help when my mind is all over the place at the moment - thank you everyone i really do appreciate it!

As RAS inferred, this is a standard Form K restriction.

What it means, in various circumstances, is discussed on the sticky thread

As two of the creditors have charges against your home then I think you should take advice from Stepchange.

I would also sign up to the free service property alerts via the land register on your house (if you are not already registered)  it alerts you via email if there are any changes to the register. Which might be an idea if they are some creditors with restrictions on there.

Also speak with your mortgage company if you have not already done so credit management/ bereavement team. They should be able to offer options as they usually have specially trained agents to help.
