Case has been transferred to a County Court far away from the Defendant's home, even the Defendant has specified a home court in the DQ form.

    Is the Defendant an individual or a company?

    The MCOL Claim History ceases to be updated, and thus of no relevance, once a claim has been transferred from the CNBC.

    I can't answer the late transfer question 

    But 

    Once MCOL have transferred the case, which your claim history shows, they have no further involvement, hence why it was not updated, and never will be. ( So nothing strange about it. )

    OK, not strange about this record update, but this is minor. The major one is the strange and unfair court change, coming out of the blue.

    You must immediately TODAY email the Central London Court and state that you object to the Order of DDJ Brooks which needs an urgent review and is in error.  The Defendant being a LiP gets to choose their home court, not the Claimant, and it is wholly unjust (and a serious error by the court) to transfer this case to Coventry.

    State that this email is sent without notice or application because the Order was made without a hearing and of the Court's own volition, and only arrived this week* and the Defendant understands that any affected party may object to such an order within 7 days of service.

    Correct court process is that such a case (Trader v Consumer) is to be heard at the Defendant's nearest home court - in London in this case - to allow access to justice for a LiP and in view of the Overriding Objective.


    Say all of the above.

    Put the
    Claim number & URGENT: ERROR IN THE ORDER DATED 6th AUGUST in the subject line and copy in UKPC (or DCB Legal if they are using them).

    Just don’t quite understand about the second paragraph, could you help to explain a bit?

    - Did you mean MY EMAIL is sent without notice or application? Or did you mean THEIR LETTER of the order I received?

    - If only making an order to transfer the case to another court, not making a judgement, is a hearing also needed for this order?

    - You mentioned “any affected party may object to such an order within 7 days of service”, could you let me know where this rule comes from?

    - Lastly, do I need to email the Coventry court as well?

    Coventry is of little interest to UKPC as that address is purely a mail drop, their HQ is Wooburn Green South Buckinghamshire.
