Letter of Claim DCB Legal Ltd


I have received my letter of claim from dcb legal ltd acting on behalf of Excel parking with the amount being £170.
I parked at the Albany Theatre in Coventry, it’s either app or cash nothing else. I used the app, however it wasn’t working properly and I didn’t have cash on me. So I ended up paying for an hour later start time. So instead of 5-7pm, I paid 6-8pm. Well I appealed to them and they didn’t care. Didn’t bother with the next stage of appeal with recommendation from the Newbies thread. They’ve been very quick with these letters in comparison to others, I assume they’re desperate for money.

Got my email reply:
Our Client reviewed your appeal and sent a reply on the 10th June 2024. Our Client confirmed that a payment was made for parking, however it is important to note that this was done outside of the specified consideration period. As clearly outlined in the signage at the car park, vehicles must have a valid payment within the designated time frame. Any payment made outside of this period does not fulfill the requirements set forth in the Terms and Conditions. Therefore, the charge has been issued correctly in accordance with the regulations stipulated on the signage.
The sum added is a contribution to the actual costs incurred by our Client as a result of your non-payment. Our Client’s employees have spent time and material attempting to recover the debt. This is not our Client’s usual business and the resources could have been better spent in other areas of the business. Had you of paid as per the Contract, there would have been no need for recovery action so the amount due would not have increased.
The HMRC ‘VAT Supply and Consideration manual’ (VATSC06140), which was last updated on 02 September 2020, confirmed that parking charge notices falls out of the scope of VAT. There is no requirement for a VAT invoice to be issued to you.
You now have 30 days from the date of this email/letter to make payment of £170.00. Failure to make payment will result in a Claim being issued against you without any further reference.

You must quote the correct case reference when making payment. If you do not, we may be unable to correctly allocate the payment. If further action is taken by us as a result of an incorrect reference being quoted, you will be liable for any further fees or costs incurred.

First you use that reply and report DCB Legal to the Inland revenue for possible Vat fraud, same as everyone else
Then start preparing your defence based on the defence template and the hundreds of Discontinuations on here3 -
Assume you already searched the forum for the easy key word (VATSC06140) and know what to do now, from reading a few other threads who also got this template reply?
HMRC VAT concerns must flood in until HMRC realise there is an issue.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
