Im going through the NEWBIES and found some other threads relevant to the case. FYI, they have reworded the initial letter from those that I am seeing on other threads (attached), mentioning POFA 2012 and other subtly worded points. In the rejection email though, they mention they do not need to rely on POFA to issue or pursue a Charge but have cited it in the initial NtK attached.

Please can you show the back page too as that is a version I'd like to add to the NTK pictures thread.  It's a real attempt at a PoFA worded NTK but I don't see a sentence 'inviting the keeper to pay' as is required in para 9 of Schedule 4.

Use LDK's admission that they are not relying on POFA against them at POPLA.

See both sides of the fine below. Funnily enough, I had another one come through the post that omitted the reference to POFA.





And the plot thickens, I have just received a letter from the debt collectors today and it's only been 1 day since LDK sent me the rejection and the POPLA code lol - ordinarily, this would have stressed me out but I realise the level of dirty tactics these people use. I am actually looking forward to drafting a POPLA response now. Will certainly mention the tactics employed by passing my information to a debt collector before any formal process with POPLA even began.

Send a complaint to LDK online, telling them you will report them to the BPA for letting ZZPS send a threatogram whilst the case is still at appeal stage and thus, cannot be escalated nor increased.  Also the current BPA CoP paragraph 24.4 has been breached (quote it).

Then when they reply, make a complaint about LDK to the BPA.

Meanwhile, no rush but do a POPLA appeal around day 30 from the rejection letter, pointing out it fails the POFA Sch4 9(2)(e)(i).
