Parking Eye Fine

Hi Everyone
My appeal has just been rejected by Parking, which is quite annoying because I thought common sense should have prevailed as I was perfectly within the grace period.
As seen in screenshots I entered the car park at 12.56 and left at 15:07. I did pay for the parking ticket until 15:01 and was within the grace period, especially considering the fact that I had a 6 week baby with me, so settling in the car and getting out of the car park can take a few minutes.
I did appeal to Parking Eye but was surprised when my appeal was rejected and just received a generic response as follows:-
"We have reviewed the details outlined in your appeal and can see that a payment to park

"We have reviewed the details outlined in your appeal and can see that a payment to park
was made on the date of the event. Unfortunately, the tariff purchased was insufficient
and did not cover the entire duration of the stay. The terms and conditions and tariffs are
outlined on the signage which are on display throughout the car park.
We are writing to advise you that your recent appeal has been unsuccessful and that you
have now reached the end of our internal appeals procedure."
I am annoyed by this and will take this up with Popla. Have others been successful with such appeals and is there a template to use? I am quite upset and wish there was a way to make these companies pay for such unfair fines.

You are unlikely to win at POPLA but if you want, try it next month, after exhausting Plan A first (see NEWBIES thread).
Either way you won't be paying even when you lose at POPLA. DO NOT PAY.
Evidence is key if trying POPLA so it is relevant that you had a baby with you and you'd need to 'paint a picture' of why you needed a few minutes to strap your baby in/out (maybe get your partner to take a video with you and your baby's faces hidden by a floppy sunhat, to show how long the process takes for a new Mum to transfer a newborn to/from a buggy THEN lock the car THEN walk to the machine or download an app). That would be good evidence.
Oh and get pics from the parent/child bays proving (I bet) that there are NO T&Cs SIGNS in that whole run of bays in that row.
There pretty much never are in accessible bay areas (you are their targets) and more people should get pics of that because that potentially wins at POPLA.
But Plan A first. No link to the NEWBIES thread because you already have a path back there (see below).PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Thanks for your help. I am surprised that I won't win with POPLA because I thought I was perfectly within the grace period. Do these car parking companies expect us to be in and out of the car park before the ticket expires.
Any idea why the 10 minute grace period rule won't be helpful for POPLA appeal because I was only over the time limit by 6 minutes. What basis of rejection would POPLA have for such cases?0 -
I did say how to do it which might win.
Your case is potentially winnable but how are you getting on with Plan A (NEWBIES thread)?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

No luck with Plan A so far as it is private land and hence still no response, which is why I appealed directly to Parking Eye as I was shocked at being penalised for 6 minute overstay. Do they expect us to magically leave the car park within a minute or something. It is upsetting and I wish there was a way to make Parking Eye pay for this harassment as my overstay was within the grace period
Any tips on Popla appeal?0 -
What do you mean by 'as it is private land'? Every single case involves private land.
I already gave you my advice on a way to win at POPLA.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
