Advice Needed on Car Purchase and Repair Rights

Hi everyone,

I need some advice regarding a car purchase I’m in the middle of. Over the weekend, I viewed a 16-month-old car with under 10k miles. It’s well-priced and in good condition overall, but I noticed some scratches on the rear bumper and scrape marks on the bottom of the steering wheel. I test drove it, and mechanically, it seems sound.

The sales rep assured me that the cosmetic damage would be repaired before I collect the car later this week. They put this promise in writing, stating they would fix the damage to the best of their ability. I’m buying on PCP but plan to withdraw within 14 days. I’ve signed the order form and paid a £500 deposit on my credit card for Section 75 protection.

Here’s where I need some clarity:

    •    If I’m not satisfied with the repairs upon inspection before finalising the purchase, what are my rights? Can I refuse the car even though I like it and want to give them a chance to correct it?
    •    Does the Consumer Rights Act 2015 apply in this situation?
    •    If they refuse to do any more repairs, can I walk away and get a refund?

Any advice or guidance would be greatly appreciated! Thanks in advance.

  • I should also point out that this purchase is through a main dealership and they claim to carry out repairs onsite.

    Why not buy the car after the repairs are carried out ?

    You are worrying a bit prematurely. 

    This is an everyday job for them, it's likely that the repairs will be unnoticeable. If you aren't happy for some reason, point out why and tell them you wont accept the car until it's sorted. They aren't likely to want to lose a sale and affect their reputation for a few quids worth of repairs - after all, they hope you'll take it back there for servicing, etc.

    in the unlikely event that you can't agree, then is the time to start thinking about rights and refunds.
