if I have a mobility car that I can't drive and the staff gets a parking ticket

  • I get high rate mobility because my supported living manager and community nurse wrote on the form and letter that when I become unwell I become a danger to myself and other people, especially people in the community when psychotic and I become verbally abusive in psychosis, they said within a week of not having my injection I become unwell. Thats why when I go on holiday in November my psychiatrist is proscribing me PRN Haloperidol as well as having my injection the day before I travel.

    How i would approach this
    1) keep a small pocket diary with car key's.. the person driving writes where and time in the diary as they take the keys.. so you can look up who was driving.  

    2) Check your contracts.. i am unsure if you employ your own PAs, use agencies, Self employed Carers or a mix.. but check for the wording as to who is eligible..or ask agencies etc

    3) If the parking ticket is my fault as i given bad info (i cant drive my team drive for me) i would pay.. if the decisioin to park and not get a ticket was support staff i would expect them to cover it.  Equally the pay isnt great and I have a great team so i think we'd negotiate.

    4) I leave a pot of coins for  car parking change with my blue badge.. so my team can take the money back when they buy tickets.. they use their phones and take coins back.  You could leave one with the car keys and diary?

    5) Who ever funds your care should have a legal advice line.. often with the insurance if you are Direct payment/ personal health budget funded they will offer advice and give you templates.   Many counties also have templates for things such as basic checks before using a car.. petrol, clean lights/number plate, tyres check etc.. that are drivers responsibility

    I don't know where or why my post has gone, so will simply repeat that in my area people in supported living do pay utility and water bills from their benefits.
    And will let the attitude in charlieismydarlings post which I do find more problematic than mine speak for itself.

    Motability are the owner and Motability retain the V5c as owner , same thing happened when I had one !

    Motability ensure that the person leasing the vehicle is the person named on the V5c with their current address, so any charges go direct to the person leasing the vehicle, the Registered Keeper 

    Authorities and private parking companies will write to the Registered Keeper,  so in this case Mr W Wonder, the OP who started this thread 

    Depending on who sends the charge, will depend on what action the Registered Keeper may or should take 

    The RK could decide to always name the actual driver, regardless of who sent the letters ,  in some cases they would have no choice but to name the driver or suffer the consequences !

    Even having a permit to park outside etc is no guarantee of Immunity from charges, charges that could arise from speeding offences,  bus lane violations, parking violations, penalties from ports, airports or train stations, or private parking company charges from shops, supermarkets, hospitals, retail parks, keisure centres etc

    Putting your name and address onto a V5C , even with Motability, places various legal and contractual  responsibilities onto the Registered Keeper , legal and contractual responsibilities due to having a signed and dated lease agreement in place with Motability, effectively as a lessee ( hirer, day to day keeper )

    Not being able to drive or not having a driving licence is irrelevant, not being the driver is no defence, but the RK can name the driver in order to comply or to get from under any issues, to pass on the responsibility to the person who allegedly caused the letter to arrive

    The above is not correct for parking tickets.  Certainly wrong advice re Council PCNs.
