Stopped in private car park on "yellow lines/hatched area" for 68 seconds

I have read the Newbies thread but nothing on this issue.

I just got a £60 (14 day discount from £100) fine for 'parking' on "yellow lines/hatched area" for 1 minute and 8 seconds. I never left the car. Afterwards I moved off and left the private car park without parking.

Back left wheel may have been just on the hatched area but this isn't shown on the image - it is debatable.

Options I am thinking of appealing on:
  • There is a car park sign in line with the passenger window. Could I claim I was reading this? They need to give enough time to read the signage?
  • Signage on entry was behind a 'to let' sign - and is only a few meters off a 30mph road that you need to turn back on yourself to enter.
  • I was waiting for someone to leave a space in front of me but they didn't end up moving so I left
Will they have the video recording of the incident and does the image shared have to be the 'full shot' or can they have zoomed in?

Are there thoughts on whether this is worthwhile / what I should do? Thanks in advance.

    Who is "they"

Name the parking company and location

I doubt that there will be any video recording
  • Usually it is just an image.
  • UK Parking Control Ltd - in Walton on Thames.

And just to clarify, it was a letter through the post received as a result of it being picked up on a high camera. Not a yellow envelope on my screen, if that makes a difference.

Post a redacted picture of the PCN, both sides, leaving the dates and allegations showing, but no private information, so redact your name and address, the VRM details, plus the reference number too, cover with card or similar

I can't believe that UKPC would use ANPR cameras to issue a PCN for such a short period of time, there should be a consideration period as you say, of at least 5 minutes, if it was UKPC and not a different company using similar names and initials

So no windscreen PCN, just a postal PCN
  • Thanks - should I redact the image on the PCN? You can't see the VRM as it is pixelated on the PCN (not enough to question whether it is my car in the online version).

Yes it was a postal PCN.

If the 2 pictures ( in & out. ) are definitely your car and your VRM, and serve no useful purpose for us, redact them, but tell us the 2 complete exact times from the cameras, so in and out times
  • Here they are. Note there is no 'in and out' as it is the 'parking' (stopping) time on the yellow hatched area that they have sent it for.

    Thanks for your help!

Meh! Just wait for the inevitable N1SDT claim form that is going to arrive, no matter what you do in the meantime, and then defend it as per the second post in the Newbies/FAQ thread and the Template defence thread. Or, you can go through the whole waste of time saga of appealing and appealing to POPLA and ignoring all the debt collector letters and reach exactly the same conclusion... an eventual discontinuation as per this thread:

DCB LEGAL RECORD OF PRIVATE PARKING COURT CLAIM DISCONTINUATIONS

So UKPC , a BPA AOS member, 66 seconds in a hatched area on private property, no in and out pictures, nobody actually parked, only STOPPED , stopped is not parking, presumably forbidding signage ( which we have not seen  ) , at 18:22:39

Date of incident, 28 july. ( But you have not shown us or told us the issue date on the postal PCN letter from UKPC

  • Yes, all that is correct. Ridiculous isn't it... :joy:

    Issue date was 31/07/2024
