Faulty item and PayPal

I brought an item via PayPal credit.  The item arrived and was faulty.  I contacted the seller who messed me about and wouldn't give me a return address or authorisation etc.

Eventually the closed the return again with no instructions on how to return.  

I contacted PayPal and opened a dispute for item not as described which also included faulty item in there description of not as described. 

A few dates later the seller sent me a postage lable to return so I sent it back. A week after it had been delivered I hadn't had a refund so sent a message asking about the refund pointing out it had been received.  I got no reply so sent a couple more messages and still nothing. 


I sent PayPal messages pointing out it had been delivered and I hadn't had a refund. 

After a few more messages to PayPal they eventually told me I wasn't covered as I had sent the  item back and I should have waited for them to tell me to send it back and closed the case.
I contacted PayPal again and pointed out that the seller sent me a return lable and had received it but again they said I shouldn't have sent it and waited for them to issue return details .
They are reviewing the case but I don't hold out much hope.

As it stands the seller has my money and the  item and doesn't respond to messages.  There is no phone number to call 

Any advice on what to do next

    Small claims court against the seller. Send him a Letter before action (LBA) giving him 14 days to refund the money or you will lodge  a claim.

    Sadly needs to be over £100 for S75, if this type of credit comes with a Mastercard or Visa card you may have the option of a chargeback. 

    Beyond that Paypal are correct that you should wait and then return to the address they tell you to to be covered by their protections which will be in addition to any rights.

    Paypal should have an official complaints procedure which might squeeze out some good will but beyond that it is as above letter before and small claims with the seller. 

    Worth checking them out online to ensure they are based in the UK, there's a lot of sellers in China using fulfilment in the UK which means even if you won there'd be no assets to claim if the seller didn't pay.

  • I looked and found out they are based in Spain.  I never knew this at the time.

    PayPal are reviewing the case. If no luck I'll raise a complaint.  

    Seems a bit of a loophole( unless you are aware)and the seller knows this as I genuinely thought PayPal had instructed them to send me a return label ( a bit like ebay do)
