    Hello everyone. Sorry for the late reply but I have been very busy with changing job but most important my wife being pregnant. 
    In the last months I received few other letters, as you can see.


    I also received the famous Letter before Claim, but when I got it I forgot to reply as advised in the Newbie thread. I'm going to do it right now. 
    But I also have something else to share with you. As you know my Popla appeal was unsuccessful, so after that I made a formal complaint and this was their response:



    So basically the complaints team stated that the parking operator didn’t use the correct language and the Popla assessor failed to acknowledge that, but still they could not change the outcome of the appeal. How ridiculous is that?

    Anyway, I’ll keep you posted.

    If you persist in processing my data and in the event of filing a court claim, take note that I will file a Part 20 counterclaim for not less than £500.  This will be claimed as damages for distress for me and my pregnant wife, arising as a result of clear breaches of the DPA 2018 and/or the Protection From Harassment Act 1997.

    I will rely upon many court cases that have succeeded.  Cancel the PCN and crawl back under your respective stones forthwith

    Preferably tell your client from me to crack on with cleaning up their act to comply with the incoming statutory Code of Practice.  Groundbreaking improvements would include issuing future Notices of Parking Charge properly and engaging fairly, avoiding involving bulk litigators like you lot in this 'extorting money from motorists' model outed by the DLUHC as a market failure.

    As for you: I suggest you stop obsessively reading parking forums (quoting influential MSE posters in your template WS is a constant source of amusement!) and go back to chasing shadows for phone contract and energy providers.

    Tempting, but they'll probably read a few lines and just delete it.

    I'd be more constructive and simply tell them that you are in receipt of their letter and that it went to Popla but they rejected your appeal in error. See attached document that will obviously be used as part of the defence.

    Copy Horizon in.

    Hold on unless I am going daft, in this ridiculous fob off about being a one stage appeal even when we got it wrong, the complaints handler has made yet another error.
    Surely this is wrong also they are stating that the assessor "allowed the appeal":


    Quite clearly the "one stage appeal" mantra is used as an excuse to uphold incorrect decisions, a one stage appeal is one thing, but this isn't a second appeal it is a complaint that they got it wrong, and then in answering the complaint got it wrong again.
    A bunch of incompetent idiots, a total sham!

    Little update. Just came back from holiday yesterday and found court claim letter waiting for me in letterbox. Issue date 2nd December. As 5 days after issue date have passed, I have now completed Acknowledgment of Service.
    I will now start to prepare the defence.

    With an issue date of 02/12/25 and having completed the AoS in a timely manner your defence deadline date is 4.00 p.m. on 05/01/26
    Can you show us the POC please; make sure you redact the claim form of any personal information, claim ref, password, name, QR code.
