Good evening all,
Based in Scotland and received a PCN from UKPA. This one has a photo of entry and exit from the car park at a retail park from which you can make out the driver of the vehicle if it came to that. (Just stating that for info).
My question is, is part 8 still in the process and therefore not law at the moment. I.e. is keeper liability still not a thing in Scotland yet? Does this photo change things?

Do you really think unregulated private parking companies have an up to date database of images of every human being in the UK with which to compare the one from their scamera systems?
As above, ignore, but watch out when the law changes thanks to your former dear leader who banged on about wanting independence but then imported a law from south of the border that will mean someone who was not in the vehicle at the material time can be held liable for a parking charge from an unregulated private parking company.I married my cousin. Lol well when you put it like that it sounds mad. I was just thinking about any trips to court etc.
But I guess it comes back to the company unlikely to take it to those measures over the cost of the PCN; £100.0 -
You can complain about the PCN as keeper to the retail park management company and try to get it cancelled by them or the Landowner, plan A. ( But no blabbing about who was driving)
Other than that, it's not worth it in Scotland under the simple procedures rules, especially as there is currently no keeper liability and only one PCN so far
Might be a different scenario next year, but plan A is universal anyway , that won't change
Most people would ignore it at the moment, in Scotland and Northern Ireland too, it's in England and Wales where its different advice. ( But plan A is Always the best option. )1 -
I challenge you to go outside and take a photo of any random person and then try and identify that person. In what universe do you imagine an unregulated private parking company can identify anyone from a photograph or CCTV still?2
