Construction noise by Villa rental - refund?
Toffee54
Recently spent a week in a rental villa which was spoilt by construction happening immediately next door.
Booked direct with villa owner who states I should have reported at the time and not wait until after my return. Says I didn’t give them opportunity to resolve eg by moving to alternative accommodation. I have video evidence and photos but owner says this doesn’t prove disruption spoilt the whole holiday. Shouldn’t they have warned me?

Where do I stand? Am I entitled to a refund and if so what percentage is reasonable?

Probably nothing given you stayed for your holiday so it couldn't have been that bad, shown by the fact you didn't report it at the time.Toffee54 said:Recently spent a week in a rental villa which was spoilt by construction happening immediately next door.

Do you dispute this in any way..?Toffee54 said:Booked direct with villa owner who states I should have reported at the time and not wait until after my return. Says I didn’t give them opportunity to resolve eg by moving to alternative accommodation.

Do you have any evidence that the villa owner was aware of the construction activity? In terms of what alternatives might have been available had you notified them at the time, is the owner an individual or a company? In which legal jurisdiction is the contract between you?Toffee54 said:Recently spent a week in a rental villa which was spoilt by construction happening immediately next door.

If this is a private arrangement rental then there is little or no come-back option. Unless the rental agreement says otherwise then they don't need to tell you about nearby construction work, or offer you any recompense.1

The villa owner's position seems entirely reasonable to me.

Unless the Villa owner lives close by. On a daily basis why would they be even expected to know the activity going on next door. If my neighbours here make a noise doing DIY or have tradespeople in while I'm in the garden enjoying the weather. There's nothing I can do.0
