Hi everybody, will this be ok for my defence paragraph 3?
"3. As the alleged breach of contract took place around four and a half years ago, the Defendant is unable to recall the driver of the vehicle. The Defendant is unsure as to why the vehicle was parked at Rodney Street, Wigan. Given the fact that the Defendant is unable to recall the driver, the Claimant is reduced to relying only on the possibility of invoking 'keeper liability' under Schedule 4 of the Protection of Freedoms Act 2012. To this end, the claim does not get off the ground because the Claimant is pursuing the keeper for £70 more than the parking charge (unlawful, per Schedule 4)."0 -
It's not a killer point to say adding £70 is unlawful. All that strikes out is the £70. The rest of the alleged contract stands unchallenged unless you respond to the allegation.
Respond to the breach allegation.
Also allege that 4 years ago Euro Car Parks did not have a Notice to Keeper that complied with Schedule 4, thus it is impossible for them to claim keeper liability.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
