  • so now the fun and games start, i registered with MCOL and tried to do the AoS but can't get past "Claim number or password is incorrect".  i'll have to fill in the paperwork and send via snail mail.

    No, you can fill in the form online and email it as a pdf attachment:

    Email it to: aos.cnbc@justice.gov.uk and CC in yourself and make sure you receiver an auto-acknowledgement email from the CNBC within a few minutes of sending it.

    "3. As the alleged breach of contract took place around four and a half years ago, the Defendant is unable to recall the driver of the vehicle.  The Defendant is unsure as to why the vehicle was parked at Rodney Street, Wigan.  Given the fact that the Defendant is unable to recall the driver, the Claimant is reduced to relying only on the possibility of invoking 'keeper liability' under Schedule 4 of the Protection of Freedoms Act 2012. To this end, the claim does not get off the ground because the Claimant is pursuing the keeper for £70 more than the parking charge (unlawful, per Schedule 4)."

    It's not a killer point to say adding £70 is unlawful. All that strikes out is the £70.  The rest of the alleged contract stands unchallenged unless you respond to the allegation.

    Respond to the breach allegation.

    Also allege that 4 years ago Euro Car Parks did not have a Notice to Keeper that complied with Schedule 4, thus it is impossible for them to claim keeper liability.

    Sorry Coupon-mad, I'm a bit confused as you posted earlier in my thread that the NTK was a POFA version, so I'm not sure which part of the NTK is non compliant, I'll keep researching and see what I can find, thanks for you help.
