Morning all,

It has been roughly 3 months since my GF presented me with a PCN, and guess what came through the post yesterday?  Another NTK - Yippie!!!

Parking Eye
Lidl Rosehill
Contravention: this is not clear (Will explain below), It is free parking for customers and we do have proof of purchase, but allegedly there was a parking terminal where she needed to put the VRN.

As always will try plan A first. I found a post here where someone did manage to get Lidl to cancel a PCN at the same location, albeit it was 2018 with a different parking operator ( Athena).

The NTK does appear to be Pofa compliant with regards to issue date and Pofa statement. 

My two questions are as follows: 

Location: It just states Lidl Rosehill. Does not provide full address, street name, postcode, etc. There aren't any other Lidl's in the same location , but unsure if they are still required to put a full address ( if location can be identified).

Second is the details of the contravention. It appears to suggest multiple causes, is not specific and seems to be all over the place. as shown in the image. 

Thoughts anyone ? 

P.S - For anyone interested, I have a partner ( GF) for sale.

Is starting to show signs of wear & tear, but plenty of mileage left in her.

Extras: comes with a full wardrobe, 20+ pairs of shoes, and a dozen handbags.
Pros: Is great company. Does a bit of cleaning, cooking & ironing every so often.
Cons: Does not take the rubbish out. Does have a tendency of getting parking tickets on a regular basis (roughly every 3 to 4 month intervals).

Early Bird Special ! - For anyone expressing interest in the first 24h, I am also willing to chuck in the 8yo kid for free.  :D

    Was checking some other pictures of NTK's from parking eye and it appears that with regards to the details of Parking charge, they have adopted a catch all approach as in. If you stayed longer than allowed, or did not purchase a ticket, or did not park within the lines, or register at the terminal, then you are liable for the parking charge.

    Has anyone tried the inadequate POC style of defence on this with POPLA or courts ? I mean they are listing the 20 things I could have done wrong on the NTK, but have not specified as to what I have done wrong exactly ( would this still be POfa Compliant)!

    You already know the procedure. Of course you can add the argument about the generality of the allegation to PIPLA but they aren’t PoC… yet!

    Lidl should get it cancelled but if they don’t and the appeal or POPLA don’t get it cancelled then it is likely to be one that PE farm out to DCB Legal as a no hoper in court and you just go through the motions until discontinuation.

    Wont go that far, but I am preparing a powerpoint presentation on the importance of reading the flipping parking signs. I do really need to drill this into her brain. 

    I am not trying to defend her, but I can also appreciate as to why she does end up getting so many PCN's. The issue is luckily/unluckily our daughter happens to be really good at tennis, so she is constantly ferrying her all over the UK to various tennis events, tournaments, training camps, etc. So, she does end up parking at various new unknown & unfamiliar locations. Combine this with the fact of having to deal with an adorable 8yo who on most occasions is being a hyperactive annoying little Sh*t, and she is running against the clock most days. 

    Unfamiliar parking location + annoying little Sh*t + time pressure = Recipe for Disaster and more work for me. 

    So as mentioned, I think it is time to have a proper chat on getting into the habit of checking the parking signs first and foremost.

    I will check, waiting on her to email me a copy of her bank statement. But we usually do our weekly shop at our Local Lidl.

    Will try that as Plan B. The only issue is that this was a different Lidl from out local ( ours does not require this stupid terminal nonsense) . However, as mention we still do have proof of purchase from this particular store. 

    ( Currently on Hold with CNBC to try to get an update on my 2 x CCJ set aside applications, as still haven't heard anything follow me having to resubmit the application on 05/06/24) 2h on hold already, i swear they are getting worse and worse.
