sorn vehicle on private carpark , tort notice

Can a tort notice be enforced if a car or van is sorn on their private land and its been established its not abandoned and contact has also been made after the tort notice has been put on the vehicle. It in a private carpark not council. Its is my belief that they cant enforced it as its not abandoned and Under the Protection of Freedoms Act it's a criminal offence to clamp or tow away a vehicle parked on private land. police , dvla and council are the only things i think that can have it removed so would they need a court order to remove it?

    You missed out the words "without lawful authority". The Torts (Interference With Goods) Act does explicitly make it legal to remove property which has been left on your land (so long as you have given the property's owner fair warning to remove it etc). So provided the landowner has jumped through the hoops laid out in the Torts Act I would think that yes, he does have lawful authority to have the vehicle towed away and sold.

    Why do you think you can just leave your car on other people's land, especially if it is SORN?  This really takes the biscuit.

    @olyoly99, your best bet is to get this thread moved to the Parking tickets, fines & parking board.

    Perhaps the easiest way to make that happen, is to simply hit the Report button below your post and ask for the thread to be moved.
