Customer rights on used car still covered by 3 months garage warranty

Options
Hi,

Serious help and advice needed!

I bought a (2011) car, on 25 May 2024 from local garage, car is still within 3 months garage warranty.
Within a week of bringing car home I realised car was going though engine oil abnormally and I had to top up every week, I only use car on weekends so, first few weeks I topped it off. I notified garage after a month that car was going through lots of oils.
They said it will be fixed by servicing which they did (no additional cost from me), this did not resolved the issue.
Since bought, car has done over 2000 miles, in the contract its states if I had to return the car, for every mile there is 90pence charge on mile used, costing me almost £2000.
Car has been with garage again for last 10 days, they have been stating they are waiting on new parts.
Now, I am left without a vehicle. Do i have a right to request a courtesy car even there is no mention of it on the contract?

How do I go on about it? What rights do I have in these circumstances?

Please help.

Thanks.

I believe you have the right to claim a full refund (no deduction) under the consumer rights act 2015.  It is accepted that there was a problem with the car and  this was promptly notified tot the retailer.
Whilst you have no right to a courtesy car, perhaps the garage would be willing to provide one if you are not requesting a full refund.

All consumer rights on used goods are tempered by reasonable expectations for the age/apparent condition etc.

For a 13yo car? There's almost nothing that would be covered. That's the average age of scrapping of a car in the UK.

Same for the warranty. They all exclude wear and tear.

How much oil is it getting through. Had a Peugeot 207 with the BMW 1.6 direct injection engine that used loads of oil. Peugeot took the stance that anything up to 1 litre per 1000 miles was acceptable oil usage.

Problem was the burnt oil kept causing the catalytic converter to fail.

Problem was solved when someone ran into the back of it and shortened the car.

That's fairly standard across all manufacturers - often litre/1000km, so 620 miles.

My missus had a 207 with that engine, and that was the same - approx 1 litre (roughly min. to max. on the dipstick IIRC) in 1000 miles.

Never caused any cat. problems though.

One of the guys at the Saab specialist that I use worked at a Pug dealer in a previous life, and he reckoned they were all like that.
