TERMS AND CONDITIONS for “KISS Ibiza x VOXI (the “Competition”). These terms should be read with our general competition terms at: http://www.bauerlegal.co.uk/radio-competition-terms.html which also apply to this Competition.

1.ENTRY ROUTE AND COSTS

Entries are restricted to one entry per person.

Entry to the Competition is available via the following route only:

·      Online at https://planetradio.co.uk/kiss/competitions/

Online entry is free of charge.

2.COMPETITION MECHANIC AND HOW TO WIN

Listeners must enter online at https://planetradio.co.uk/kiss/competitions/for their chance to participate in the below on-air competition.

Online Entry:

Online entry for this competition is open from 24/07/2024 00:01 (“Start Date”) and closes 08/08/2024 at 15:00 (“End Date”). Entries received before the Start Date or after the End Date will be invalid and those entrants will not be considered in any further stage of the competition.

Ø Online entry at https://planetradio.co.uk/kiss/competitions/ where the entrants must enter the below detail to take part in the competition:

o   Enter their contact details including name and email address.

o   Provide a written account (for which there is no word limit) of which four people they would take to Ibiza with them and why, this could include their roles in the friendship group, personalities, friendship history etc.

o   We shall be selecting two separate entries for the week, with two different groups of five friends coming to air and playing the on-air game. They shall both have the opportunity to win the first part of the prize, as described below (5 - The Prize). One group shall also win an enhanced version of the prize, also described below (5- The Prize).

o   By entering, they confirm that they and their four friends are available to travel to Ibiza 22/08/2024-25/08/2024.

o   By entering, they confirm that their friends consent to participating in the competition and that all four of their friends are happy to come to air, in order to take part in the on-air competition.

o   By entering, they confirm that they and their friends have valid passports and are able to travel.

o   By entering, they confirm that they are happy to appear both on air and on socials, as instructed by the KISS FM production team. This will be during the time period of the KISS Ibiza Campaign (05/08/2024-25/08/2024). Further details shall be provided, but this is likely to include self-shot content for social media, on-air audio and appearing in social content, as instructed by the KISS FM Production Team.

Shortlisting Process:

Ø Entries will be judged on how entertaining, compelling, and heart-warming the entry is. All entries will be judged by the KISSFM Breakfast production team, the production manager, and an independent judge.

Ø We will be shortlisting from the opening of the competition from the 24/07/2024 at 12:01 until the close of the competition online entry period on 08/08/2024 at 15:00. We shall shortlist two groups of five friends, both of which will come to air and have the chance to win. The two groups are not going head to head, but instead have the opportunity to both successfully win the prize.

Ø The successful shortlisted entrants will be contacted by a member of the KISS production team and asked to reiterate their entry over the phone and confirm their and their four friends’ availability between 06:00 – 11:00 from 05/08/24 – 09/08/2024, when the on- air competition stage will take place. Dependent on availability, we may have multiple people from the group of five appear on the show each morning. Each member of the group will need to appear at least once. This will happen for both groups of five.

Ø On shortlisting, we will require the entrant to explain and talk through their entry. The entry must be compelling and match the entry that was entered online. They must confirm that all five of their group are happy to be part of the competition. The entrant will be asked to provide confirmation that their four friends referred to in the entry are also free to attend KISS Ibiza (22/08/2024-25/08/2024) and are happy to appear alongside them in content, as described above. Phone numbers will only be used in relation to this competition i.e. never for marketing purposes. We shall repeat this process for both shortlisted entrants, who have entered their group of five.

Ø Being called during the shortlisting period does not mean that the entrant has got through to the on-air competition stage. For example, a shortlisted entrant will not proceed to the on-air competition if (i) they are unavailable on the required dates, (ii) they do not consent to appearing in KISS FM content, (iii) their story does not match the judging criteria, or (iv) their friend no longer wishes to participate in the competition.

Ø If the entrant is successful in the shortlisting stage, they will be contacted before the end of the shortlisting period by the KISS production team to organise the date and time of their on-air competition stage.

On-Air Competition Stage:          

Ø Upon being successful during the shortlisting period, the entrant will be invited to participate in an on-air competition stage. This stage can take place on the Breakfast Show daily between 06/08/24 – 09/06/24, between the times of 07:00 – 11:00. Each of the five members will be take part in an on-air competition be on a different day to the other members of their entry group. The KISS team will cooperate with the entrants to select an appropriate date, but if the entrant cannot participate on any of the required dates, they will be eliminated from the competition.

Ø We reserve the right to shortlist further entries from the pool of online entries should any of the original shortlisted entries not proceed.

Ø Upon shortlisting, the KISS Production team will ensure that all members of the group are available to attend KISS Ibiza 22/08/2024-25/08/2024 and that they are happy to appear in content throughout this period. If they are not, they will be eliminated from the competition and the KISS Production team will approach another group from the shortlist. This will continue until two finalists are confirmed. 

Ø During the on-air process, the entrant from the group, for that day, will be asked to answer a question, given by the KISS Production team. These shall questions with subjective answers, designed to only be answered correctly.

Ø Upon successfully answering the question, the entrant shall be announced as a winner and they shall have secured their place on the trip. Each member of the group of five shall have to successfully answer their own question, on different days, in order to secure their own spot on the trip.

Ø The winner will be announced as the winner on-air by the KISS Breakfast presenters.  

Ø The KISS production team reserves the right to pre-record any part of this competition with contestants before as the ‘as-live’ broadcast.

DATES OF COMPETITION STAGES

On-Air Competition Stage:

The on-air competitions will take place from 07:00 – 11:00 from 05/08/2024 – 09/08/2024 on the KISS FM UK Breakfast show. Exact dates and times of each competition within this date range will be organized between the shortlist entrants and the KISS Production team during the shortlisting stage.

The winners of the competition (i.e. the winning person from the group each day) will be announced on-air daily 08:00 – 11:00 on 05/08/2024-09/08/2024 on the KISS FM Breakfast show.

4. ENTRY RESTRICTIONS

·      Open to UK residents aged 18 years or over on date of entry with a valid passport.

·      Our employees (and their family members) or employees of any company involved in the Competition, including any Prize Provider, are not permitted to enter.

·      We reserve the right to disqualify any entrant or winner who does not comply with any of the eligibility criteria and/or is in breach of these Terms. We reserve the right to repeat the competition mechanic or any stage of it in order to draw a winner that fulfils all of the eligibility criteria and is in compliance with these Specific Terms.

The second part of the prize will be provided by NDL. Bauer Radio Limited is not responsible for any aspect of this aspect of the Prize, including unsatisfactory quality, unavailability of preferred seats, or late delivery or a prize winner being unable to take up any aspect, or the entirety of the prize due to their own circumstances or restrictions.

▪ Return transfers from the airport to the hotel

▪ 3 Night’s accommodation at the 4* Hotel Vibra District

One of the two groups shall also win the following additional prize package:

The Prize Provider is NDL Ltd. Any personal data submitted by the winner to the Prize Provider will be treated in accordance with Prize Provider’s privacy policy.

 

TERMS & CONDITIONS 1. Flights will depart from London Stansted on Thursday 22nd August at 1645 arriving in Ibiza at 2025 and will depart from Ibiza on Sunday 25th August at 1245 arriving at London Stansted at 1425. 2. Prize includes return economy flights, all flight taxes, and surcharges as well as one piece of cabin baggage per person. If you don’t hold a UK passport you may need a visa for this destination, and this should be arranged with the appropriate embassy. Although please note the cost of a visa of this kind isn’t included in your prize. 3. Just so you are aware, transfers to the hotel/airport are not private and you will be sharing with other passengers. 4. You will be staying in a 4* hotel, sharing two double rooms and one single occupancy room been 5 people with en-suite bathroom on a bed and breakfast basis. 5. Spending money will be transferred directly to the winner upon confirmation of full and correct bank details. Transfers can take up to 5 working days. 6. Travel insurance is subject to normal terms of acceptance. Pre-existing medical conditions may not be covered. No age restrictions apply. Should NDL Group be unable to purchase travel insurance on the winner’s behalf, a cash sum of £75.00 will be provided to the winner via bank transfer.

 

OTHER CONDITIONS

1.       DATA PROTECTION. Names, email addresses, and /or telephone numbers (which, for all SMS competitions, will be shared with our SMS provider) will be collected and used to process entries. Winner’s details may be given to a Prize Provider to arrange delivery of the prize. Your details may remain stored after the End Date but will not be used for marketing unless you have ticked an opt-in box on entry. If you have opted in to receive marketing communications, then your details will be used in accordance with the information given when you ticked the opt-in box and gave your consent. 2.       INTELLECTUAL PROPERTY AND CONSENTS. By entering this Competition, you are consenting to our use of your entry both to publicise this Competition, our radio station or any other radio station which we own or control. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted on entry, in any media, without paying you any remuneration therefore and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize if applicable. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had.

 

3.       MISCELLANEOUS.

·      Entries which do not comply with these Specific Terms or the General Competition Terms and Conditions will not be accepted and any entries may be disqualified if we have any reason to suspect that there is a breach of, or non-compliance with, these Specific Terms.

·      Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given and whether they are correct, we reserve the right to amend what we deem a correct answer, however we are not obliged to, and our decision in either case is final and no correspondence will be entered into.

·      We are not responsible if you fail to get through when you call / text to enter, or if you lose signal during a call.

·      You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via any SMS or phone call entry route.

·      We accept no liability for network, technical or signal errors, issues or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition.

·      Whilst on-air, you must not make any inappropriate, profane, indecent, harmful or offensive statements. If you do so we reserve the right to take you off-air immediately and disqualify you from the competition. You may be also disqualified from the competition at any time if you are incomprehensible, inaudible or if you appear to be driving, intoxicated or likely to offend listeners. Any prize already won may be withdrawn and re-awarded to another entrant.

·      As far as it is lawful to do so we exclude our liability for any losses suffered in connection with the Competition or any element of the Prize.

We may cancel, end or suspend the Competition where we are required to do so in circumstances outside our control. We reserve the right to amend these Specific Terms at any stage during the Competition if such amendment is necessary to facilitate the administration of the Competition.
