Advise on court claim please..

Hi all, I received the notice of allocation to small claims track letter. I've to send my witness statement to the court by 7th Dec.
Can you advise if there's a specific template for this and also should I send it by post?
Just to refresh- there was an error in the way BW-Legal calculated the interest. They added it from the date of parking day rather than from the date after the initial period for payment and appeal etc. Can someone advise what should I mention in the witness statement? Should I include WS from my partner as well who is a registered driver on the vehicle and knows about the case in detail?
Thanks for your help in advance.0 -
There are no templates for the Witness statement bundle, just recent examples of Bundles by other victims on here, study a few of them
Email is the usual method
December 7th 2024 seems months too early to me, check the court order again, carefully. ( You are supposed to be at the mediation stage but you have not updated us since September. . )
No such thing as a registered driver, just a driver2 -
Thanks @Gr1pr, will look for bundles in the forum. The mediation was over with no success and the case was moved to my local court. The court trial date is on 22 Jan and the WS to be submitted no later than 4pm Dec 9th (sorry was a typo, not 7th).
Any suggestion on the POC with regards to interest calculation errors?0 -
If you're arguing about interest, they've won and you're so deep in damage limitation you're shaving off what you can - the bolt ons and the daily rate.
A witness statement should primarily deal with the facts and getting the whole of the claim rebutted, cause then there's no interest to fret about. The DJ will almost certainly approach a hearing on that basis2 -
Recent WS are on threads by:

@Defendant911
@Milliered
And the usual Exhibits are listed where you'd expect to find them. In the NEWBIES thread WS stage advice section.
