I purchased a pair of shoes online with delivery saying a couple of days. This time passed and the shoes didn’t turn up. I contacted the store and they got back to me. They said they can’t get them from their suppliers and don’t know when they can.
They went on to say I have two choices, wait to see if they can get stock or cancel. The cancel option said
“ We can contact the stock point and request a cancellation as a exception and if accepted we will refund you”
Now looking on my online account they are saying the item can’t be cancellled?? I can return the shoes. How can I return something I might never get?
I have opened a Section 75 on my credit card, does the shop have a leg to stand on in this situation?

Open a non receipt chargeback.

The merchant has an opportunity to dispute and keep/get their funds back - for example by sharing tracking data showing you received the item.

I had this recently with john lewis, raised a dispute with credit card company who are investigating but in the meantime have refunded me1

Go to your Banks website and search for "dispute Visa transaction".
