Gym faulty air con

I paid for a year's membership to a leisure centre (gym and swim).

In early April I got in touch because some gym machines weren't working, and there was no air con (or windows able to be open).

No one replied.

I got in touch again at the end of June.

They didn't say why they didn't make any changes in April, or respond (beyond the receipt to confirm they had they email), but nor are they willing to refund me for the three months which the gym has been intolerably hot - more a sauna than a gym. Ten minutes in and I was quite sick, so I left and went on a many hour cycle instead (cool air males all the difference!).

I was told there were other working machines available (true) but that they wouldn't offer a refund for three months (and though they are now finally actioning this, there's no deadline for when the work will be done so it could still be a while before there's air con - due to its location, there are no external windows).

Is that it? A complaint can be escalated but for stages 1-3 it is dealt with by the same person, and there is no stage 4 (unless you complain about the complaint process). Should I just take my loss and know not to bother renewing next year?

This covers it to save retyping :)

So no legal requirements but possibly Health and Safety issues.

Possibly report to the council if you feel the temperatures are unsafe.

You could argue reduced benefit of the contract due to the service not being carried out with due care and skill with regards to Health and Safety in order to seek a price reduction but gyms don't seem to be notorious for their generosity, worth following the complaint process to see if you can squeeze anything out of them.

You have found the MSE way. 👍

Don't tell them that, they will be charging more for extra feature 🤣

Did the gym have aircon when you joined? It's not entirely clear from your post.

Your post reads a bit odd.  You "got in touch" with the gym in April and again in June.
Were you not actually at the gym and using the gym facilities and would simply raise the comments while present in person?

Faulty air con of itself is not an issue in a gym and there can be fans or other ways of controlling temperature - especially as the period you mention it was not especially warm weather.

Most gyms of any size will often have some pieces of equipment unavailable for one reason or another.

Hot Pilates is very much trending in the fitness studios of Palm Springs and Las Vegas

'...as the name suggests, it’s taught in a hot space and it’s going to make you sweat — a lot. The room is heated to 95°F (35°C) and set at 40% humidity.'

Why didn't you talk to someone while you were there? That would seem to have been the most obvious thing to do.

In all honesty, it sounds like you've simply changed your mind about wanting to use the gym and are looking for reasons so that you can cancel/get refunded.

If you really want to use the gym, why not go along now and talk, in person, to someone on reception or one of the fitness instructors?
