Car accident insurance question

Young driver in car accident pulled into a road he said was clear. Very tight bend on hill car came down and hit him in the side. Other driver said that son at fault. No police called. No pictures taken. Other driver asking for £900. His car has no tax, the car itself has no insurance attached to it. He says he has insurance. So we presume he is 3rd party insured. Is his insurance valid as no tax, and can he make a claim against my son as it will mean he won’t be able to get insurance again at any reasonable rate.

    Of course he can claim against your son.
    Whether he will get anything from your son's insurer is another matter.


    Just get your son to report the accident, and claim for his repairs from his own insurer, then it doesn't matter who's fault it was or whether the other driver was insured.
    Give the other driver the details of your son's insurance policy and invite him to put in a claim if he wishes.

    You son will as a matter of course claim it was 100% the other driver's fault.


    Let the insurance worry about it, your son's premium will increase but c'est la vie as they say in Birmingham.


    (No tax or MOT is not a barrier to being insured, and in any case the Road traffic act requires that his insurer meets any third party claims whatever)

    Which driver is your son?  The one who came out of junction or one coming down hill?  Let the insurance companies deal with it.

    Thanks for the responses. It was my son who pulled into the road. Other driver is asking to settle £900 without insurer involved. Son’s car not badly damaged both cars drove away.

    End of. Nothing else in this situation is his problem.

    Your son needs to contact his insurer. I presume he gave the other driver his insurance details at the scene?

    I don't believe we can opine about fault until we have far more detail than the OP has provided. Since his account i second-hand, that's unlikely to happen.

    BTW, there was no need to provide insurance details.

    Where is the £900 coming from ? The other driver doesn’t want insurance involved as he wasn’t insured himself. Just leave it in the hands of your insurance company, that’s why you pay for insurance.

    Your son is obliged to inform his insurer of the accident by the terms of his policy.

    If he doesn't, and they find out even 3 years from now, then Very Very Bad And Expensive Things Will Happen.

    He doesn't have to claim, and can even offer to pay the third party claim himself, but it will make very little difference to his future premiums whether or not he pays up himself.

    Putting it through insurance avoids any escalation in costs such as when the third party needs to hire a Lamborghini while his car is being repaired, and the medical claims for whiplash & PTSD for the driver and all 4 passengers.

    His choice, but I advise putting it through insurance...
