Following up on my POPLA appeal. Should i comment to operator evidence?

I have submitted a POPLA appeal regarding my parking ticket. The private operator uploaded documents from his side. Do i need to comment? There are more documents but this is what they mentioned in the case summary.


I have submitted a POPLA appeal regarding my parking ticket. The private operator uploaded documents from his side. Do i need to comment? There are more documents but this is what they mentioned in the case summary.
Please see case summary and additional evidence. The motorist was parked
in a staff parking permit only car park - they have paid for parking in
the opposite car park which is across the road. Contract – The
contract between UK Parking Control Ltd and the landowner (or their
managing agent) authorising UKPC to provide parking management, and
therefore issue parking charges to vehicles breaching the terms of
parking, is confidential and we are unable to provide a copy for reasons
of commercial sensitivity. We have however provided a redacted copy,
with sensitive information covered. The redacted contract confirms our
authority in an ongoing agreement. If neither party terminates the
contract, as in this case, the contract will continue on a rolling
basis. We have provided the T&C’s in relation to the rolling
contract. Thank you
My initial appeal to the operator was regarding signage, but when appealing to POPLA I have investigated and found there are multiple BPA violations? .
The photo of the signage i submitted was the above and what they submitted was the below one.


If you are a new visitor it is very easy to get confused. There are many reviews on the google with the same problem. when you enter there are actually 2 car parks one to the left and one to the right. It is very easy to get missed and yellow NCP sign being very big, you would not even think twice to look at other signs on the site.

Always give comments, especially when there are parts of their evidence pack that bolster your appeal points to their detriment, or where they have failed to counter your appeal, so definitely look for the weak points like BPA failures, no landowner authority and poor signage etc ( ( you cannot add new appeal points, but you can comment on their evidence pack when it assists your case. )
You have 6 days from being notified ( not 7 days. ) to submit your comments3 -
If they have failed to respond to any point, then state that the operator has agreed with you by default, and therefore the appeal must be allowed.
Otherwise, as mentioned above, rebut every point they have made, but not that you can't add new points.

Well their photo submission has no date stamp on it so could be an office stock copy from any time not at the parking event, and clearly shows that the entrance signage doesn't conform, and does not show current conditions as yours does where their signage is not facing the motorist.

Hello all,It took a while for POPLA to come back after submitting my appeal. I have lost the appeal which was received 3 days ago.I was just wondering where did it go wrong as i was expecting it to be a success.Attaching both the documents below.Document submitted by me (below)POPLA result (below)Also UKPC was very quick to send me the email with in few hours of the POPLA result regarding the money I owe them .Thanks.

Nothing has 'gone wrong'. It doesn't matter. Losing at POPLA is normal. About 50-50. This was never the 'be all and end all' of our advice.

Waffling on to POPLA about rain and rushing and what your were doing is of no interest to them!Where did you state that the UKPC have no date stamps on their photo evidence?Where did you state that as this car park was for permit holders only there could be no contract to park with a non permit holder?POPLA go into these appeals on the side of their paymasters you have to tip them the other way with hard evidence most of that was just padding I'm afraid, but no matter get on to the next stage and continue till the dimwits pull the plug.4

Hello all,A positive update regarding my appeal.The land was managed by Savills and owned by Aegon AM (Pension fund).
UKPC uploaded a document for the POPLA Appeal, which contained the contract details and the person who signed it.
Even though POPLA rejected my appeal, the document helped me find who managed the land . After searching more I got to know the land was owned by Aegon Pension fund.
I emailed both of them and finally i got the PCN cancelled. (Although it took more than a month)Thanks again every one.7
