Section 38 agreement

Hi I've had a query in relation to searches carried out in my property that's being sold. We live on a housing development and the search has found the roads have not yet been adopted. So they're asking for a copy of the section 38 agreement which I can't find. Where can I attain a copy of this?Could my buyers solicitor contact the developer or council for this if I haven't got a copy?

    That's one of the queries they have forwarded on I've not responded to them yet.was just curious as to where a copy of this can be found and is something the buyers solicitor should be chasing with developer or council.if u don't have a copy
  • If the roads are never going to be adopted then there won't be one - are you sure they will be?

    It's likely at some point the roads will be adopted but it's been like that for over 13 years now, we keep hearing it's almost there and going to be adopted.Its quite common with adopting roads from what I've heard.
  • Most of the things I've read about section 38 suggest that the process is complete about 12 months after construction, but I've never been involved with one myself.

    It's a council / developer thing, so either of those might have a copy - I'd say better you asking them than the buyer.
