CCJ from 2001

Hi All

Just when I thought I had completed my journey from hopeless debtor to wannabe saver/overpaying mortgage, a debt collection letter from Lowell drops through my letterbox.

Apparently I owe Hoist Finance Uk (never heard of them) £379.59. 

I call Lowell and get through to someone who finds the debt and says it’s something relating to GE Capital but he doesn’t know what date it’s from. So I say if it’s Ge Capital then the debt is well over 10 years old and will be statute barred, but ah, he says, it won’t be because there is a CCJ logged against this from 2001 (suddenly he finds a date). 

I have no record of any CCJ from any time at all and I have never had anything in writing to inform me of a CCJ. I told him I had no CCJ on my credit file and he said no it won’t appear now as it’s so old but it’s still logged against this debt.

My questions are as follows:

If there was a CCJ logged in 2001 can this debt now be chased 23 years later?

Surely they will have to provide me with proof of a CCJ to prove this debt isn’t statute barred?

Any help appreciated.

    I think you hit the nail on the head.   Ask them to prove you owe the debt. And ask them to prove you are supposed to be paying them.

    Put it in writing and post it snail mail.  Don't give them anything (emails, mobile etc) which gives them an in to bothering you.  

    There's been a lot of fishing exercises going on with a number of collection agencies of late.  I think a lot of debts have been sold on so there may be a very murky trail back to whomever you may have owed money to in the past and if they can't prove you have to pay it then they can go whistle.

    A ccj can only be enforced after 6 years by permission of the court

    It's highly unlikely a court could find a record going back that far, let alone give permission to enforce it.

    Agreed, the debt is dead in the water but they want you to think otherwise.
