  • I am in the process of completing a Lasting Power of Attorney form on line and would be grateful for views on including the following wording under Section 7.

    I would like my attorneys to give gifts to family members on customary occasions such as weddings, births, birthdays and Christmas. 

    I would like all gifts to be reasonable, affordable and in keeping with my normal habits taking into account how much money is available.

    It is my understanding that gifts out of surplus income is allowed anyway but is it better to include formally (especially if the gifting rules change at some point)?

    Any disadvantages by including in the document?

    Also, if included is it better under Preferences or Instructions?

    Would it be easier to just include a letter of intent along with the LPA so people know what you want and you can put it in plain English?

    Thanks for your comments.  Do you mean just having a letter sitting entirely outside of the POA and leaving Section 7 blank?  I'm sure this would work but just wanted to sound out as to whether it was more appropriate in the POA.

    I’m not sure how it would work as an instruction. 
    Because which family members are you talking about? Son’s, daughters, third cousins twice removed? But if it gets too specific and stands a chance of failing then the OPG will reject it. 
    If you’re going to put it in, I think it will be better as a preference.
