Terms and Conditions IONIQ 5 N Driving Experience Competition

1.            The Promoter

The Promoter is: Hyundai Motor UK, a company incorporated in England and Wales (company number 05446560) whose registered office is at Birchwood Building, Springfield Drive, Leatherhead KT22 7LP (the “Promoter”).

2.            The Competition

The title of the competition is: IONIQ 5 N Goodwood Driving Experience 2024 (the “Competition”).

3.            The Prize

The “Prize” is one of 10 IONIQ 5 N Goodwood Driving Experience. The event will be held on 26th August 2024 at Goodwood Motor Circuit.

3.1.        The Prize does not include travel to and from Goodwood.

3.2.        The Promoter reserves the right to substitute the Prize with another prize of a similar nature or equivalent or greater value at any time. There is no cash alternative for the Prize.

3.3.        The Prize is not negotiable or transferable.

4.           How to enter

4.1.        The Competition will run from 17:00 on 16th July 2024 (the “Opening Date”) to 23:59 on 29th July 2024 (the “Closing Date”) inclusive.

4.2.        All Competition entries must be received by the Promoter by no later than 23:59 on the Closing Date. All Competition entries received after the Closing Date will be automatically disqualified.

4.3.        To enter the Competition, entrants must fill out the entrance form at (https://ioniq5ndrivingexperience.uk/) by the Closing Date.

4.4.        Entry into the Prize Draw is free (except for any applicable data usage charges).

4.5.        The Promoter will not accept:

(a)       responsibility for Competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

(b)       proof of commenting under the Instagram competition post will act as proof of receipt of entry to the Competition.

4.6.        By submitting a Competition entry, you are agreeing to be bound by these terms and conditions.

4.7.        Please contact the Promoter at 0800 981 981 if you have any problems entering the Competition.

4.8.        The Competition winners will be selected at random from all entries received.

5.           Eligibility

5.1.        The Prize Draw is open to UK residents aged 25 years or above and not older than 75 years old holding a full, current and clean UK or EU driving licence, except:

(a)       employees of the Promoter or its holding or subsidiary companies;

(b)       employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the Competition or its administration; or

(c)       members of the immediate families or households of (a) and (b) above or

5.2.        The Promoter may ask each winner to provide proof of age.

5.3.        To participate in the Prize you confirm that:

(a)       You are the holder of a current UK driving licence permitting you to drive motor cars on UK highways;

(b)       You are over the age of 25 years and not older than 75 years of age;

(c)       You have held a valid full driving licence for a minimum of 1 year;

(d)       You do not have 6 points or more on your driving licence or have had committed a major driving offence within the past 2 years.

5.4.        In entering the Competition, you confirm that you are eligible to do so and eligible to claim the Prize. The Promoter may require you to provide proof that you are eligible to enter the Competition.

5.5.        The Promoter will not accept Competition entries that are:

(a)       automatically generated by computer;

(b)       completed by third parties or in bulk;

(c)       illegible, have been altered, reconstructed, forged or tampered with; or

(d)       photocopies and not originals.

5.6.        There is a limit of one entry to the Competition per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

5.7.        The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the Prize Competition.

5.8.        Competition entries cannot be returned.

6.           Health Declaration

6.1.         All winners  taking part in the driving experience must sign a full Health Declaration and indemnity form upon arrival at the event. The winner should arrive at Goodwood Motor Circuit one hour prior to their driving experience.

6.2.        The minimum age to participate in a driving experience is 25 years old.

6.3.        The maximum age to participate in a driving experience is 75 years old.

6.4.        The minimum height to participate in a driving experience is 4ft 10in.

6.5.        The maximum height to participate in a driving experience is 6ft 4in.

6.6.        The maximum weight to participate in a driving experience is 20 stone.

6.7.        Appropriate clothing and footwear must be worn at all times during the event and the winners must wear glasses if required.

7.            Winners

7.1.        The decision of the Promoter is final and no correspondence or discussion will be entered into.

7.2.        The Promoter will make all reasonable efforts to contact each winner. If a winner cannot be contacted or is not available, or has not claimed their Prize within 48 hours of the announcement date, the Promoter reserves the right to offer the Prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

7.3.        The Promoter does not accept any responsibility if you are not able to take up the prize.

8.            Claiming the Prize

8.1.        Winners will be contacted by the Promoter within five working days of the competition closing.

8.2.        The Promoter will make all reasonable efforts to contact each winner. If a winner cannot be contacted or is not available, or has not claimed their Prize within 48 hours of the announcement date, the Promoter reserves the right to offer the Prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

8.3.        The Promoter does not accept any responsibility if you are not able to take up the Prize.

9.            Limitation of Liability

9.1.        Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

9.2.        All vehicles available to drive at the event will be insured by the Promoter for use, in the UK only, by drivers authorised by the Promoter with a full, current UK or EU driving licence.  No contents insurance is provided.

10.          Data Protection and Publicity

10.1.      The Promoter will only process your personal information as set out in the Privacy Notice available at https://www.hyundai.co.uk/legal/privacy.

10.2.      By participating in the event, you acknowledge and agree to grant the Promoter including any of its agents the right to record, film, live stream, photograph, or capture your likeness in any media now available or subsequently developed and to distribute, broadcast, use, or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you for the purpose of promoting the event, including any outcome, and promoting any products manufactured, distributed or supplied by the Promoter.

10.3.      The Promoter shall be the absolute owner of any and all photographs, film, video and other materials (and all rights therein, including the copyright) produced pursuant to these Conditions.

11.         General

11.1.      If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Competition.

11.2.      The Promoter reserves the right to hold void, suspend, cancel, or amend the Prize Competition where it becomes necessary to do so.

11.3.      These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
