CCJ - original debt date

Hi. I've been given a CCJ for a mail order debt originating from 2017 ( so over 6 years ) but the date of default was 2019. I made no payments in that time. Should it have been/can it be statute-barred because of it's age?

It would not have been statute barred as the cause of action date would have been the date of default, that`s only 5 years, so no.

That is unless you are in Scotland, are you?

Legal action removes the limitation act as a defence after the fact anyway, if you had given thought to having the date of default backdated by way of complaint, that may have swung things your way, and that would have been a reasonable defence, but that boat has long since sailed.

Any reason why you did not defend the claim when you had the chance?
