Well done on your win
Gwent Civil and Family Court (in Newport).
I have no idea the name of the judge or how to find that out actually.
Well Done!
ANOTHER VCS ONE BITES THE DUST!
She might be right that SHE usually finds in favour of parking firms but generally across the UK (all courts) that isn't the case. We've seen 99% wins and discontinuances for a decade.
Now give yourself a pat on the back for winning because VCS try hard!AND ... IMPORTANT NEWS!
Do get your revenge: please read this message and do the vital, current Public Consultation:
https://forums.moneysavingexpert.com/discussion/comment/81552148/#Comment_81552148
It's important that the Government hears from people like you with unfair charges who are facing horrific, scary court claims.
The link shows the two vital points to concentrate on, IMHO:
- banning 'fee' add-ons completely.
- making sure a new SINGLE appeals service replaces POPLA and the IAS which are seen as not fully independent and involved in a 'race to the bottom'.
Click through to the main thread about the Consultation, Do not be deterred by the fact that some questions are for the parking industry only.
We are currently discussing how to respond. Please join us in doing this Consultation before it closes in three weeks. This is your one chance to make a difference re the proper regulation of private parking.

The fact that parking firms are 'very litigious' isn't a valid reason to keep finding for this industry of rogues and telling a Defendant they were 'lucky'. What a patronising moo!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

She also said that if the lights had turned green during the stop, or if the lights were not red, we would have obviously lost,The judge appears to be confusing contract law with the Road Traffic Act.

We deal with hundred of these cases and it is very rare that this would fall in your favour, these companies are very litigiousProbably thinks all those DCB Legal cases that come across her desk are mysteriously discontinued because the Defendant has paid 😆2
